Land Transport Act 1998

Notification of Ordinary Rule

Pursuant to section 161(3) of the Land Transport Act 1998, notification is hereby given of the making of Land Transport Rule: Operator Licensing Amendment 2008, which amends Land Transport Rule: Operator Licensing 2007.

The amendment Rule makes changes relating to transport service licence cards, Area Knowledge Certificates, exemptions relating to Certificates of Knowledge of Law and Practice, “special interest vehicles”, and requires all taxi operators to belong to an approved taxi organisation.

With the exception of some provisions relating to taxi services, which will come into force on a date to be notified in the New Zealand Gazette, the Rule comes into force on 1 August 2009.

Land Transport Rule: Operator Licensing Amendment 2008 (Rule 81001/1) is available for inspection free of charge at the National Office of the NZ Transport Agency, Victoria Arcade, 44 Victoria Street, Wellington, and for purchase in October 2008 at selected bookshops that sell legislation.

Land Transport Rule: Setting of Speed Limits 2003

Variable Speed Limit in School Zone—Mosston School

Pursuant to clause 6.1 of Land Transport Rule: Setting of Speed Limits 2003 and a delegation from the New Zealand Transport Agency, I, Lyndon Bryan Hammond, Manager Networks, approve a 40 km/h variable speed limit at Mosston School in accordance with the conditions set out in this notice.

Conditions

  1. Variable Speed Limit

    Wanganui District Council may set a speed limit of 40 km/h on Mosston Road, between Buxton Road and Tayforth Road, which operates during the periods specified in condition 2 of this notice. At all other times the speed limit on Mosston Road, between Buxton Road and Tayforth Road, is the permanent speed limit for that section of Mosston Road.

  2. Periods of Operation

    The 40 km/h speed limit may operate on school days for a maximum period of:

    (a) 30 minutes before the start of school, until the start of school;

    (b) 20 minutes at the end of school, beginning no earlier than 5 minutes before the end of school.

  3. Signs

    Signs that comply with Land Transport Rule: Traffic Control Devices 2004 must be installed to mark the beginning and end of the variable speed limit in the school zone as follows:

    (a) at least one R1-6 “School zone variable” sign at each end of the variable speed limit on Mosston Road, facing road users travelling towards the variable speed limit; and

    (b) at least one R1-7 “School zone ends” sign at each end of the variable speed limit, facing road users leaving the variable speed limit.

  4. Length of Variable Speed Limit

    The variable speed limit in the school zone on Mosston Road must be a minimum length of 300 metres.

  5. Bylaw

    Wanganui District Council must set the variable speed limit on Mosston Road by making a bylaw in accordance with Land Transport Rule: Setting of Speed Limits 2003.

  6. Monitoring and Reporting

    Wanganui District Council must monitor traffic and pedestrian behaviour and make progress reports to the New Zealand Transport Agency. The reports must include measurements of vehicle speed and pedestrian numbers; and records of crashes, enforcement activity and the operating times of the variable speed limit as agreed with the New Zealand Transport Agency.

Expiry

This approval expires on 31 January 2010 and unless otherwise notified in the New Zealand Gazette the variable speed limit and the associated signs at Mosston School are to be removed by that date.

Definition

School zone means a length of road outside a pre-school, primary school, intermediate school or secondary school.
