Notice of Entry into Possession of Mortgaged Land

Pursuant to Section 156 of the Property Law Act 2007

In exercise of the mortgagee’s power to enter into possession of mortgaged land contained or implied in memorandum of mortgage 7443703.1 (Wellington Land Registry), Palmerston North Finance Limited (as mortgagee) entered into possession of the mortgaged land known as Taharoa Station, Whakarua Road, Masterton, on 12 September 2008.

Notice of Entry into Possession of Mortgaged Property

To: Melissa Ann Tuck, 985 Ohauiti Road, Ohauiti, RD 3, Tauranga;
And: Cider Trustee Limited, Aspen House, 40 Willow Street, Tauranga.

In the matter of section 156 of the Property Law Act 2007, and in the matter of mortgage instrument 6115140.3 (South Auckland Land Registry) (“the mortgage”):

TEA Custodians (Bluestone) Limited (“the mortgagee”) under the mortgage, gives notice as follows:

  1. On 31 August 2008, the mortgagee under the mortgage entered into possession of the mortgaged property.

  2. The description of the mortgaged property is Lot 10 DP 315504 (Computer Freehold Register 60974) (South Auckland Land Registry), being the property at 985 Ohauiti Road, Ohauiti, RD 3, Tauranga.

  3. The address of the mortgagee’s registered office is Level 5, 10 Customhouse Quay, Wellington.

Notice is hereby given that Bank of New Zealand, as mortgagee under mortgage 7072265.3 (“the mortgage”) over the lessee’s interest under lease D494862.1 in the property located at 99 Remuera Road, Remuera, Auckland (described in Computer Freehold Register 63469) (North Auckland Land Registry) (“the property”), entered into possession of the property on 10 September 2008.

The secured property is described as:

All present and after acquired personal property of Weka Developments (Christchurch) Limited.
