Fisheries (Kaimoana Customary Fishing) Regulations 1998
Fisheries (Kaimoana Customary Fishing) Notice (No. 8) 2008 (No. F451)
Pursuant to Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Programme Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.
Notice
- Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 8) 2008.
(2) This notice shall come into effect on Tuesday, 22 July 2008.
- Interpretation—In this notice:
(a) "customary food-gathering" has the same meaning as defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) "Tangata Kaitiaki/Tiaki" means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana.
(c) "area/rohe moana" means, firstly, all that area of water enclosed by a line commencing at the mean high-water springs (MHWS) at Kakaraea (Karaka Point) (36°24.5'S; 174°21.1'E), then proceeding generally west to a point (36°23.9'S; 174°12.8'E), then proceeding generally south-west to a point (36°25.9'S; 174°06.6'E), then proceeding due west to the Exclusive Economic Zone to a point at latitude 36°25.9'S, then proceeding generally north along the Exclusive Economic Zone to a point at latitude 35°58.6'S, then proceeding due east to a point on the coastline north-west of Mahuta Gap (35°58.6'S; 173°45.5'E), then proceeding generally south-east along the MHWS following the northern reaches of Kaipara Harbour to the point of commencement; and, secondly, all that area of water enclosed by a line commencing at the MHWS at Langs Beach (36°02.5'S; 174°31.1'E), then proceeding due east to the Exclusive Economic Zone to a point at latitude 36°02.5'S, then proceeding generally south along the Exclusive Economic Zone to a point at latitude 36°09.9'S, then proceeding due west to Te Arai Point (36°09.9'S; 174°39.3'E), then proceeding generally north along the MHWS to the point of commencement. The geographical coordinates named are in terms of the WGS84 datum.

Nomination of Tangata Kaitiaki/Tiaki—Te Uri o Hau has nominated Thomas De Thierry, Sandra Thompson, Ross Walker, Mihi Watene and William Wright as the Tangata Kaitiaki/Tiaki for managing customary food-gathering within the area/rohe moana.

Appointment of Tangata Kaitiaki/Tiaki—On 26 June 2008, the Associate Minister of Fisheries confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Thomas De Thierry, Sandra Thompson, Ross Walker, Mihi Watene and William Wright as the Tangata Kaitiaki/Tiaki for managing customary food-gathering within the area/rohe moana.

Confirmation of tangata whenua—Te Uri o Hau is confirmed as the tangata whenua of the area/rohe moana to which the appointment of Tangata Kaitiaki/Tiaki relates.

Power to authorise the taking of fisheries resources for customary food-gathering—A Tangata Kaitiaki/Tiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, other than those resources that are taken in fresh water, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki/Tiaki.

Pursuant to Regulation 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Programme Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

- Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 7) 2008.
(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.
- Interpretation—In this notice:
(a) "customary food gathering" has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.
(b) "Tangata Tiaki/Kaitiaki" means the person or persons appointed under Regulation 9 or 10 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within an area/rohe moana.
(c) "area/rohe moana" means the area from the Waitaki River to the Pareora River, extending seaward to the limit of the South Island fisheries waters (as defined in Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, being the 200-mile limit) and inland to boundaries defined for Te Rūnanga o Waihao under the First Schedule of Te Rūnanga o Ngāi Tahu Act 1996.

Nomination of Tangata Tiaki/Kaitiaki—Te Rūnanga o Waihao, being representative of tangata whenua who hold manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Maku Davis as a replacement Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.
