1512 NEW ZEALAND GAZETTE, No. 58 31 MAY 2007

and 47(2)(c) of the Maritime Transport Act 1994, acting
under delegated authority hereby give notice as follows:
The owner of M/V Arahura (IMO 8201454), is exempt
from the requirement in Rule 40B.21(2)(a) of Part 40B
of the Maritime Rules in relation to Regulation 26.2.1 of
Chapter III of SOLAS 96–98 Amendment, subject to the
following conditions:

  1. Actions must be taken to ensure the ships comply with
    Regulation 26.2.1 at the owners earliest convenience
    and not later than 30 June 2007 at 24:00*; and

  2. the maximum number of persons on board shall be
    limited to two hundred and sixty-four during the period
    of this exemption.

The exemption from the provisions of Maritime Rule
40B.21(2)(a) shall enter into force 15 June 2007 at 00:01*.

The exemption from the provisions of Maritime Rule
40B.21(2)(a) shall remain in force until:

(a) the above condition is not met;
(b) the ship undergoes major alteration;
(c) the ship operating limits are permanently changed;
(d) the ownership of the ship is changed;
(e) the exemption is revoked by the Director of
Maritime New Zealand; or
(f) the expiry date;
whichever occurs first.

This exemption shall expire on 30 June 2007 at 24:00*.
