  1. The extent to which the proposed service is
    consistent with the definition of a non-commercial
    broadcaster.

  2. The capability of the proposed service to commence
    within two years.

  3. The extent to which the proposal increases the
    diversity of programme choice for viewers.

  4. The extent to which a proposal can provide
    non-commercial services not being provided on a
    national level. These may include parliamentary
    broadcasts, educational services such as foreign
    language programming, religious programming,
    coverage of minority sports, and New Zealand
    documentaries and short films.

  5. The extent to which the proposal provides access to
    local and regional programme makers.

  6. The extent of geographic coverage possible for non-
    commercial services, given spectrum capacity.

  7. The extent to which time is made available for non-
    commercial uses, including prime time.

  8. The extent to which the proposal can demonstrate
    that its overall objective is "not for profit".

  9. The prospect that the proposal will be implemented.

  10. The extent to which the proposal contains sufficient
    accountability mechanisms to ensure that it
    delivers on its undertakings to provide services.
    Arrangements may include:

A. mechanisms for equitable allocation of air
time amongst all interested users;

B. procedures for resolving disputes over
allocation of time to users;

C. systems for ensuring efficient management
of services;

D. provision of satisfactory services to the full
variety of audiences to be catered for;

E. mechanisms for ensuring compliance by all
users on the frequency with broadcasting
standards.

  1. Any potential future public benefit from providing
    for the transition of services to digital transmission.

  2. Any other benefits the proposal may offer.

  3. Application of this notice—You shall comply with the
    directions set out above in relation to all applications for
    radio licences, including applications made before the date
    of this notice but not dealt with before that date.

  4. Revocation of previous notices—All previous statements
    of Government policy made pursuant to section 112 of the
    Act are hereby revoked.

Notice of Direction for Appointment of a Limited Statutory Manager for the Board of Trustees of Kaikohe Intermediate School (1022)

Pursuant to section 78M of the Education Act 1989, I direct
the Secretary for Education to appoint a limited statutory
manager for the Kaikohe Intermediate School Board of
Trustees because of the operation of risks to the school and
the educational performance of its students.

The following functions, powers and duties of the board are
to be vested in a limited statutory manager:

● All functions, powers and duties of the board as the
employer (whether statutory or not).

A limited statutory manager must also advise the board on
the following:

● Consolidating all new and improved systems into board
management practice; and

● improving communication and relationships between the
school and its community.

This notice takes effect the day after the date of publication.

29 March 2007.

the Education Act 1989, and acting with authority delegated
by the Minister of Education, I hereby declare invalid
the election for the parent representatives for the Tawa
Intermediate School
Board of Trustees held on 8 May
2007, require a new election to be held on 27 June 2007, and
declare that the trustees who held office on 8 May 2007
remain in office until the close of the day before the day
when the new trustees take office.

This notice takes effect on the day of notification.
