Notice of Exemption From Maritime Rules

24A.4(6)(b) and 24A.6(7)(b)

I, John Norman Keith Mansell, General Manager Maritime
Operations, Maritime New Zealand, being satisfied that the
granting of this exemption will not breach New Zealand’s
international obligations, and pursuant to sections 47(2)(b)(i),
47(2)(b)(iii) and 47(2)(c) of the Maritime Transport Act
1994, acting under delegated authority hereby give notice as
follows:

The masters and owner of M/V Santa Regina (IMO
8314562), M/V Monte Stello (IMO 7807093) and M/V Kent
(IMO 7627950) are exempt from the requirement in Rules
24A.4(6)(b) and 24A.6(7)(b) of Part 24A of the Maritime
Rules, in relation to the requirement of appendix 1.3(1)
concerning the placard arrangements for road vehicles
carrying dangerous goods under section 5.3.1.1.4.1.1 of the
International Maritime Dangerous Goods Code (“IMDG
Code”), – “a freight container, semi-trailer or portable tank
shall clearly display placards one on each side and one on
each end of the unit”, subject to the following conditions:

  1. All other applicable requirements of Maritime Rule
    Part 24A and the IMDG Code shall be adhered to;

  2. international voyages shall not be undertaken;

  3. crew responsible for dealing with emergencies on
    vehicle decks must be made aware of the type and
    location of dangerous goods prior to commencement
    of the voyage; and

  4. road vehicles must comply with the section 7.3 of Land
    Transport Rule 45001/1 “Dangerous Goods 2005”.

The exemption from the provisions of Maritime Rules
24A.4(6)(b) and 24A.6(7)(b) shall remain in force until:

(a) one or more of the above conditions is not met;

(b) the ship(s) undergoes major alteration or its operating
limits are permanently changed;

(c) the ownership of the ship(s) is changed;

(d) the exemption is revoked by the Director of Maritime
New Zealand; or

(e) the expiry date;

whichever occurs first.

This exemption shall expire on 5 April 2008 at 09:00*.

Notice of Exemption From Maritime Rule 24B.10(3)

I, John Norman Keith Mansell, General Manager Maritime
Operations, Maritime New Zealand, being satisfied that the
granting of this exemption will not breach New Zealand’s
international obligations, and pursuant to sections 47(2)(b)(iv)
and 47(2)(c) of the Maritime Transport Act 1994, acting
under delegated authority hereby give notice as follows:

The masters of M/V Santa Regina (IMO 8314562), M/V
Monte Stello
(IMO 7807093 and M/V Kent (IMO 7627950)
are exempt from the requirement in Rule 24B.10(3) of Part
24B of the Maritime Rules, which states – “The master of a
ro-ro ship must ensure that a road freight vehicle, road tank
vehicle or road livestock vehicle, taken on board the ship,
having a gross mass of 3.5 tonnes or more, is fitted with
vehicle securing points complying with the requirements of
ISO 9367-1”, subject to the following conditions:

  1. The master must ensure that all cargo units are
    secured in accordance with the requirements of the
    ships “cargo securing manual” before the ship
    commences a voyage; and

  2. the master must not accept cargo on board if the
    master is not satisfied that it can be transported safely.

The exemption from the provisions of Maritime Rule
24B.10(3) shall enter into force 30 June 2007 at 00:01*.

The exemption from the provisions of Maritime Rule
24B.10(3) shall remain in force until:

(a) one or more of the above conditions is not met;

(b) the ship(s) undergoes major alteration or its
operating limits are permanently changed;

(c) the ownership of the ship(s) is changed;

(d) the exemption is revoked by the Director of
Maritime New Zealand; or

(e) the expiry date;

whichever occurs first.

This exemption shall expire on 31 December 2007 at 24:00*.
