Electricity Act 1992
Notice of Making of Electricity Governance Amendment Rules (No. 45) 2007 and Notice of Reasons for Decision

Pursuant to section 172I of the Electricity Act 1992 (“Act”), I notify the amendment of the Electricity Governance Rules 2003 (“Rules”) under section 172H of the Act.

The empowering provisions for the Electricity Governance Regulations in relation to which the amendments to the Rules are made are sections 172D(1)(3), 172D(1)(4) and 172D(1)(5) of the Act.

A brief description of the nature of the amendments is as follows:
(a) Amendment of Technical Code A of Schedule C3 of Part C to require asset owners to meet duplicate protection requirements at future grid interface voltages at or above 220 kV a.c.;
(b) addition of a new appendix in Technical Code A to clarify the technical requirements for duplicate protection;
(c) addition of specific provisions in that new appendix for the treatment of existing assets which are non-compliant;
(d) addition of new definitions of the terms, “back up protection system”, “circuit breaker failure protection system” and “main protection system” in Part A of the Rules (as used in the amendments); and
(e) a minor typographical change to the defined term, “circuit breaker”, to remove the hyphen between the words “circuit” and “breaker” wherever it is used in the Rules.

Pursuant to section 172Z(4) of the Act, the reasons for my decision to amend the Rules are to:
(a) clarify the existing obligations in Technical Code A of Schedule C3 of Part C relating to duplicate protection; and
(b) extend the existing duplicate protection obligations to future grid interface voltages above 220 kV a.c.

These rules come into force on 31 May 2007.

Notice of Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003 – Rule Amendment Proposal No. 76, 2007

This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 (“Rules”), Rule Amendment Proposal No. 76, 2007, is issued by the Electricity Commission (“Commission”), established, under the Electricity Act 1992 (“Act”), pursuant to section 172E(2)(c) of that Act.

Section 172E(2)(c) of the Act provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy, the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.
Recommendation
- On 12 April 2007, the Commission made a recommendation that Rule 3.3.2 of Section V of Part G of the Rules be amended.
Recommended Amendments to the Rules

The recommended amendment to the Rules will require the pricing manager to publish demand half-hour metering information each trading day for each trading period of the previous trading day.

Hazardous Substances and New Organisms Act 1996
Notice of Intention to Apply for Approval of Code of Practice
Pursuant to section 79 of the Hazardous Substances and New Organisms Act 1996, the Environmental Risk Management Authority gives notice of its intention to apply for the approval of the Code of Practice Above Ground Stationary Tanks with Integral Secondary Containment (including Portable User Facilities).
The code sets out a means of compliance with the requirements of Schedule 9 clause 3 and Schedule 10 clause 33(1)(b) of the Hazardous Substances (Dangerous Goods and Scheduled Toxic Substances) Transfer Notice 2004 (as amended) in respect of above ground stationary tanks with integral secondary containment and which contain hazardous substances with 3.1 hazard classification.
