Final Determination of Dumping Investigation:

Diaries From The People’s Republic of China
and Malaysia

Pursuant to section 13 of the Dumping and Countervailing
Duties Act 1988 (“the Act”), I hereby give notice that
I have made a final determination that, in relation to the
importation or intended importation of the goods specified
in the First Schedule to this notice (“the subject goods”):

(a) the subject goods are being dumped; and
(b) by reason thereof, material injury to the New Zealand
industry has been and is being caused.

Notice is hereby given that, acting pursuant to subsections
14(1) and 14(4) of the Act, I have determined the amount of
anti-dumping duty to be imposed on the subject goods to be
the rates set out in the Second Schedule to this notice.

Pursuant to section 17(b)(ii) of the Act, I have determined
that the anti-dumping duty shall be payable from 1 February
2008.

Goods Subject to Determination

Country of Origin

The People’s Republic of China and Malaysia

Description of Goods

Diaries with or without covers excluding: diaries with steel
ring binders; and wall planners.

The goods are currently classified under tariff item
4820.10.00 and Statistical Key 02J of the Tariff of
New Zealand, which classification is provided for
convenience and Customs purposes only, the written
description being dispositive.

Second Schedule

Amount of Anti-dumping Duty

The amount of anti-dumping duty to be paid on demand, in
respect of each importation of diaries imported or intended
to be imported into New Zealand from The People’s
Republic of China and Malaysia, shall be the ad valorem
percentage rates specified below which shall be applied
to the value for duty of the goods.

Termination of Dumping Investigation: Diaries

From the Special Administrative Region of Hong
Kong China, Indonesia and the Republic of Korea

Notice is hereby given that, pursuant to section 11
of the Dumping and Countervailing Duties Act 1988,
I have terminated a dumping investigation undertaken
in accordance with section 10 of that Act into diaries,
with or without covers, excluding diaries with steel ring
binders and wall planners from the Special Administrative
Region of Hong Kong China, Indonesia and the Republic
of Korea.

I have terminated the investigation in respect of the
Special Administrative Region of Hong Kong China,
Indonesia and the Republic of Korea as I am satisfied that
there was insufficient evidence of dumping of the said
diaries to justify proceeding with the investigation.

Regulations 1998

Cancellation of Licence for an Early Childhood Centre

Pursuant to Regulation 12(1)(d)(iii) of the Education
(Early Childhood Centres) Regulations 1998, and acting
under authority delegated by the Secretary for Education,
I hereby cancel the licence dated 29 May 2000, which was
granted under those Regulations to Ron Huata in respect
of Tauparanui ki Heretaunga Kohanga Reo (55149)
(8C043), situated at 1 Maraekakaho Road, RD 5, Hastings.

This notice shall take effect the day after the date of its
notification in the New Zealand Gazette.

Cancellation of Licence for an Early Childhood Centre

Pursuant to Regulation 12(1)(d)(i) of the Education
(Early Childhood Centres) Regulations 1998, and acting
under authority delegated by the Secretary for Education,
I hereby cancel the licence dated 2 May 2007, which was
granted under those Regulations to Glenda Oborn in
respect of Kindercare Learning Centres (209) (70019),
situated at 311 Riccarton Road, Christchurch.

This notice shall take effect the day after the date of its
notification in the New Zealand Gazette.
