Schedule 4

New Schedule 2A to the principal notice

After Schedule 2 to the principal notice, insert new Schedule 2A as follows:

Schedule 2A

New controls for pesticides

1 Export-only substances
2 Substances used in the formulation of pesticides
3 Application onto or into water
4 Permissions required for application or use of a substance
5 New control for paraquat
6 New control for permethrin

Export-only substances

1 Export-only substances

The hazardous substances described in Table 2 of Schedule 1 may only be manufactured for exportation and may not be offered for sale or otherwise used in New Zealand.

Substances used in the formulation of pesticides

2 Substances used in the formulation of pesticides

No person may use a hazardous substance described in Table 3 of Schedule 1 for any purpose other than as an ingredient or component in the manufacture of another substance or product.

Application onto or into water

3 Application onto or into water

(1) No hazardous substance described in Schedule 1 may be applied onto or into water.

(2) Despite subclause (1), a hazardous substance described in Schedule 1 with variation code 6A may be applied onto or into water.

(3) For the purposes of subclause (2), where the water has the potential to leave the place containing the application area, any application of the hazardous substance must be under the personal control of an approved handler.

(4) In this clause, water means water in all its physical forms, whether flowing or not, and whether over or under ground, but does not include water in any form while in a pipe, tank or cistern.
