  1. Title—This notice is the Hazardous Substances (Sodium Fluoroacetate) (Amendment) Transfer Notice (No 2) 2006.

  2. Commencement—These amendments come into force on 1 July 2006.

Schedule

In Schedule 2 to the notice:

  1. in the change to controls for New Regulation 9A, omit subclause (3) and substitute the following:

"(3) Subclause (1)(c):

(a) applies to pilots, aircrew, and airline ground personnel loading and handling a hazardous substance within an aerodrome; but

(b) does not apply to the storage and handling of a hazardous substance in any place that is not within an aerodrome, or within an aerodrome by non-airline ground personnel."

  1. immediately after the change to controls for New Regulation 9A, insert the following:

"New regulation 9B The regulations apply to each hazardous substance described in Schedule 1 as if the following regulation were inserted immediately after regulation 9A:

9B Exception to approved handler requirement for aerial application of certain substances

Regulation 9 is deemed to be complied with if, in the case of the aerial application of a hazardous substance, the person who carries out the application has a current pilot chemical rating in accordance with Part 61 of the Civil Aviation Rules."

Vehicle Exhaust Noise (Exemption From Test Requirements) Notice 2006

Pursuant to Regulation 29 (7) of the Traffic Regulations 1976 ("the Regulations"), and pursuant to an authority delegated to me by the Director of Land Transport ("the director"), I, John Patrick White, Manager Vehicles, Land Transport New Zealand, exempt motor vehicles of the types listed in the first column of Schedule A as follows:

  1. I exempt motor vehicles of the types listed in the first column of Schedule A from the requirements of Regulation 29 (2) of the Regulations provided that:

(a) the director is satisfied that the vehicle was manufactured to a standard which enabled the vehicle when manufactured to comply with the applicable noise level in Schedule 1 of the Regulations, and has not been modified from that standard; or

(b) the vehicle’s exhaust noise, when measured according to the Low Volume Vehicle Standard 90-20 (Exhaust Noise Emissions), does not exceed the applicable noise limit for that vehicle in Schedule A.

  1. I exempt motor vehicles of the types listed in the first column of Schedule A from the requirement in Regulation 29 (4) of the Regulations to comply with the levels set out in Schedule 1 of the Regulations provided that the vehicle’s exhaust noise when measured according to Low Volume Vehicle Standard 90-20 (Exhaust Noise Emissions) does not exceed the applicable noise limit for that vehicle in Schedule A.

Schedule A: Exempted Vehicles and Noise Levels

This Gazette Notice comes into force on 19 July 2006.

This Gazette Notice expires on the date when it is superseded by the coming into force of any amendment to Land Transport Rule: Vehicle Equipment 2004 requiring the measurement of exhaust noise for entry and in-service inspection and certification of motor vehicles.
