Notice of Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003 – Rule Amendment Proposal No. 80

This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 ("Rules"), Rule Amendment Proposal No. 80, is issued by the Electricity Commission ("Commission"), established under the Electricity Act 1992 ("Act"), pursuant to section 172E (2) (c) of the Act and section 13 of the Interpretation Act 1999.

Section 172E (2) (c) of the Act provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy, the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.

Section 13 of the Interpretation Act provides that a statutory power may be exercised to correct an error in a previous exercise of the power.
Recommendation

The Commission made a recommendation on 16 January 2006, that the Minister of Energy’s notice in the New Zealand Gazette, 22 December 2005, No. 210, page 5383 ("principal notice") concerning the making of Electricity Governance Amendment Rules (No. 33) 2005, be amended to correct errors in the recommendation to which the principal notice related.

The recommended amendment to the New Zealand Gazette notice was to:
(a) refer to a corrected version of Table 1 of Schedule F3A as notified in the principal notice (due to an administrative error, the version of that table contained in the Schedule referred to in the principal notice was incorrect); and
(b) extend the date on which Schedule F3A comes into force to 16 February 2006.

Notice of Proposed Land Transport Rules
In accordance with section 161 (2) of the Land Transport Act 1998, Land Transport New Zealand, on behalf of the Minister of Transport, gives notice of his intention to make Rules concerning driver licensing and vehicle emissions, and advises that the following draft Rules are available for public consultation.
Land Transport (Driver Licensing) Amendment Rule (No 2) 2006
This draft legislation is intended to amend Land Transport (Driver Licensing) Rule 1999, which sets out the requirements for obtaining and renewing a driver licence.
The proposed amendment Rule will facilitate changes to the system for licensing older drivers, including removal of the requirement for the mandatory older driver test for persons aged 80 years and over.

Submissions on draft Land Transport (Driver Licensing) Amendment Rule (No 2) 2006 close on 28 February 2006.
Land Transport Rule: Vehicle Exhaust Emissions (2006)
This draft legislation is intended to build on the measures already in place to reduce air pollution from vehicle emissions.
The proposed Rule would introduce a visible smoke check at vehicle inspections to complement police enforcement of the existing 10-second smoky vehicle rule.
It would also delay, by a year, the implementation date of the Euro 4 emissions standard, so as to prevent problems with the supply of, and after-sales support for, new heavy diesel vehicles in the New Zealand market.

Land Transport Rule: Traffic Control Devices 2004
Pedestrian Crossing Warning Lights Trial
Pursuant to subclause 3.4 (1) of the Land Transport Rule: Traffic Control Devices 2004 and pursuant to a sub-delegation to me by the Director of Land Transport, I, Peter Graeme Croft, Manager Networks, hereby authorise the installation and maintenance of experimental warning lights:
(i) for the purpose described in Schedule 1;
(ii) in the form and use set out in Schedule 2;
(iii) at the locations stated in Schedule 3;
(iv) for the period specified in Schedule 4; and
(v) subject to the terms and conditions detailed in Schedule 5.
These experimental warning lights shall be used for the purpose of evaluating their use and the experiment shall be called the "Pedestrian crossing warning lights trial".
