Telecommunications Act 2001

Notification of Draft Determination for Telecommunications Service Obligations for TSO Instrument for Local Residential Service for Period Between 1 July 2003 and 30 June 2004

On 23 December 2005, the Commerce Commission (“Commission”), pursuant to section 86 (a) of the Telecommunications Act 2001 (“the Act”), prepared a draft determination of the matters set out in section 88 of the Act for the TSO instrument for local residential telephone service for the period between 1 July 2003 and 30 June 2004.

Pursuant to section 86 (b) of the Act, the Commission gives public notice of its draft determination. A public copy of the draft determination is available on the Commission’s web site at:

Amendment to Notice of Making of Electricity Governance Amendment Rules (No. 33) 2005 and Notice of Reasons for Decision

1. On 22 December 2005, pursuant to section 172I of the Electricity Act 1992, I notified an amendment to the Electricity Governance Rules 2003 (“Rules”) under section 172H of the Electricity Act 1992 (New Zealand Gazette, 22 December 2005, No. 210, page 5383) (“principal notice”).

2. The principal notice amended the Rules by inserting a new Schedule F3A – Core Grid Determination (“Schedule F3A”) into Section III of Part F of the Rules.

3. On 16 January 2006, the Chair of the Electricity Commission advised me that Table 1 of Schedule F3A, as notified in the principal notice, contained errors.

4. The purpose of this amendment to the principal notice is to replace the Table 1 of Schedule F3A containing errors with a corrected Table 1 and to delay the date on which the amended Rules come into force.

5. Pursuant to section 172I and 172H of the Electricity Act 1992 and section 13 of the Interpretation Act 1999, the principal notice is amended as follows:

(a) By omitting clause 3 and substituting the following clause:

“3. A brief description of the nature of the amendment is as follows:

The amendment is to insert the core grid determination into Section III of Part F of the Rules as Schedule F3A – Core Grid Determination.

Table 1 of Schedule F3A is as set out in the report to me of 16 January 2006 entitled ‘Amendments to Gazette notice for making of Electricity Governance Rules (No.33) 2005 – core grid determination’; and”

(b) by omitting clause 5 and substituting the following clause:

“5. These Rules come into force on 16 February 2006.”

6. Copies of the Rules may be inspected free of charge or purchased from the Electricity Commission, Level Seven, ASB Bank Tower, 2 Hunter Street, Wellington.
