Decision to Investigate IHUG Bitstream Application

On 10 March 2006, IHUG Limited applied, under section 20 of the Telecommunications Act 2001 (“the Act”), for the Commerce Commission to determine terms of supply for access to, and interconnection with, Telecom’s fixed PDN (Public Data Network) (“the application”).

Pursuant to section 25 (1) (c) of the Act, the Commerce Commission gives public notice that it has decided, under section 25 of the Act, to investigate the application.

Electricity Governance Regulations 2003

Notice of the Amendment of Exemption No. 3

Pursuant to Regulation 196 of the Electricity Governance Regulations 2003, the Electricity Commission (“Commission”) gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 3 (Norske Skog Tasman Limited)) Exemption Amendment Notice 2006.

(2) In this notice, the Electricity Governance Regulations (Exemption No. 3 (Norske Skog Tasman Limited)) Exemption Notice 2004* is called the “principal notice”.

(3) This notice comes into force on 1 April 2006.

  1. Amendment to principal notice—(1) The principal notice provides an exemption from the requirement to comply with Rules 6.1, 6.4 and 6.5 of Technical Code B of Schedule C3 of Part C of the Electricity Governance Rules 2003 (“Rules”).

(2) The principal notice is amended by omitting the date on which the exemption is stated to expire (31 March 2006) and substituting 31 March 2008.

  1. Reasons for amendment—The reasons for this amendment are as follows:

(a) It will allow time for the Commission to finalise a recommendation to the Minister of Energy on the appropriateness of the exemption test in Rule 6.6 of Technical Code B of Schedule C3 of Part C of the Rules; and

(b) It will allow sufficient time for the system operator to make software changes required to implement any proposed changes to the Rules; and

(c) It will allow sufficient time for participants wishing to request an exemption against any such amended Rules to make that request and allow the Commission time to consider such a request without the participant being in alleged breach of the Rules.

(3) This notice comes into force on 1 April 2006.
