New Zealand’s international obligations, and pursuant to
sections 47 (2) (b) (ii), 47 (2) (b) (iv) and 47 (2) (c) of
the Maritime Transport Act 1994, acting under delegated
authority hereby give notice as follows:
The owner and master of MV Aratere (IMO 9174828),
is exempt from the requirement in Rules 45.4 (1) and
45.4 (2) of Part 45 of the Maritime Rules in relation to
Rule 45.10 (1) (a) – “a ship of 10,000 GRT or more is
to be fitted with two radar installations each capable
of operating independently of each other”, subject to the
following conditions:
- Actions must be taken to ensure the ship complies with
Maritime Rules 45.10 (1) (a) at the owner’s earliest
convenience and not later than 9 December 2006; - one 10cm radar must be fitted, be fully operational at
all times during a voyage and meet the performance
standards as set out in IMO resolution A.477(XII); - the electronic charting system fitted must be fully
operational at all times during a voyage; - AIS system fitted must be fully operational at all times
during a voyage; and - information displayed on the 10cm radar screen must
be closely monitored during a voyage for the purpose
of minimising the risk of collisions.
The exemption from the provisions of Maritime Rule
45.4 (1) and (2) shall remain in force until:
(a) one or more of the above conditions is not met;
(b) the ship undergoes major alteration or its operating
limits are permanently changed;
(c) the ownership of the ship is changed;
(d) the exemption is revoked by the Director of
Maritime New Zealand; or
(e) the expiry date;
whichever occurs first.
This exemption shall expire on 9 December 2006 at 0900
hours.

Under section 159N (4) and section 159Y (3) of the Education
Act 1989, the Minister of Tertiary Education and the Tertiary
Education Commission (TEC) give the following notice.
Notice
- Title and commencement—(1) This notice may be cited
as the Education (Exemptions from Charter and Profile
requirements for PTEs that currently do not receive TEC
funding but have qualifications approved for access to the
Student Loans and Allowances schemes and will have
qualifications approved for access to Student Component
funding from 1 January 2007) Notice 2006.
(2) This notice applies from the date of its publication. - Introduction—All organisations that seek or receive
funding from the TEC must have an approved Charter and
Profile unless exempt from the requirement to have a
Charter and Profile.
Exemptions From Charter and Profile Requirements
for 2007
The Minister exempts the following type of tertiary education
organisation (TEO) from the requirement to have a Charter
in 2007 and the TEC similarly exempts these same TEOs
from 2007-09 Profile requirements:
Those Private Training Establishments (PTEs) that
currently do not receive TEC funding but have
qualifications approved for access to the Student Loans
and Allowances schemes and will have qualifications
approved for access to Student Component funding from
1 January 2007.

and pursuant to an authority delegated to me, I, Paul
