Notice of Making of Electricity Governance Amendment Rules (No. 42) 2006 and Notice of Reasons for Decision

Pursuant to section 172I of the Electricity Act 1992 (“Act”), I notify the amendment of the Electricity Governance Rules 2003 (“Rules”) under section 172H of the Act.

The empowering provisions for the Electricity Governance Regulations, in relation to which the amendment to the Rules is made, are paragraphs (a) and (b) of section 172D (1) (1) of the Act.

The amendment is to update Schedule D2 of Part D of the Rules by:
(a) inserting information regarding several new points of connection to the grid;
(b) deleting two superfluous and, in some cases, inaccurate, columns of information (“meter” and “location” columns); and
(c) amending other inaccurate data.

The amendment is made in reliance on section 172F (3) of the Act.

Pursuant to section 172Z (4) of the Act, the reason for my decision to amend the Rules is that the Electricity Commission is required under Rule 2.3 of Part D of the Rules to publish, from time to time, updates of the details in Schedule D2 of Part D.

These rules come into force on 16 November 2006.

Notice of Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003 – Rule Amendment Proposal No. 91, 2006

This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 (“Rules”), Rule Amendment Proposal No. 43, 2006, is issued by the Electricity Commission (“Commission”), established under the Electricity Act 1992 (“Act”), pursuant to section 172E (2) (c) of that Act.

Section 172E (2) (c) of the Act provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy, the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.
Recommendation

On 11 October 2006, the Commission made a recommendation that Rule 20.4 of Schedule C4 of Part C of the Rules be amended.

The recommended amendment to the Rules was to clarify that the system operator be required to use reasonable endeavours to publish all temporary security constraints (except frequency-keeping constraints) within 10 minutes of their application to the Scheduling, Pricing and Dispatch model. The recommended amendment would allow the system operator to publish constraints electronically on the information system.
