Notice of Meeting of Creditors

Pursuant to section 243 of the Companies Act 1993, notice is hereby given that a meeting of creditors of Wayby Investments Limited (in receivership and in liquidation) (“the company”), has been requested by one of the claiming creditors, and as such, will be held at the offices of Cole-Baker, Seventh Floor, 44 Wellesley Street West, Auckland, on Friday, the 20th day of October 2006 at 3.00 p.m.

Business

1. To discuss the financial position of the company.
2. To discuss the most beneficial way for all concerned to proceed.
3. To discuss and vote on the appointment of an alternative liquidator.

Proxies

Creditors who have lodged a proof of debt may exercise their right to vote either by being present in person or by proxy or by postal vote.

Creditor companies must be represented by a person with a proxy to be able to vote or holding written authority.

All voting papers must reach the office of the liquidator not later than the 19th day of October 2006 at 10.00 a.m.
