Special Needs Grants Amendment 2006
Pursuant to section 124 (1) (d) of the Social Security Act 1964, the Minister for Social Development and Employment makes
the following amendment to the Special Needs Grants Programme (as established and approved on 18 December 1998).

Amendment

Title—This amendment is the Special Needs Grants Amendment 2006.

Commencement—This amendment comes into effect on 1 October 2006.

Programme amended—This amendment amends the Special Needs Grants Programme*.

Essential Needs—The following clause is inserted after clause 11.7:
“11.8 Repair and maintenance of on-site effluent treatment systems
11.8.1 At any time before 1 July 2008, the chief executive may make a grant of not more than $300.00 towards the cost of
the repair or maintenance of an on-site effluent treatment system if:
(a) the need for the repair or maintenance is immediate and essential; and
(b) the applicant:
(i) is the owner (within the meaning of section 61E of the Act), whether solely or jointly or as a tenant in
common with another person or persons, of the premises serviced by the on-site effluent treatment system,
and resides in those premises; or
(ii) is the occupier of a dwelling on Maori land (within the meaning of the Maori Land Act 1993) in multiple
ownership where the following conditions apply:
(A) the applicant occupies the dwelling with the permission of the land owners; and
(B) the applicant does not pay a financial consideration (or pays only a nominal consideration) for either
the right to occupy the land or the right to occupy the dwelling; and
(C) the dwelling is serviced by the on-site effluent treatment system; and
(D) the applicant is responsible for the maintenance of the on-site effluent treatment system.
11.8.2 An applicant may receive more than one grant under clause 11.8.1 in a two-year period but the total sum of those
grants must not exceed $300.00.
11.8.3 In this clause, on-site effluent treatment system means any system for treating human effluent located on the land
on which an applicant’s premises or dwelling is erected and includes, but is not limited to, a septic tank, a long drop
toilet, and a compost based toilet.”.
- Expiry of clause 11.8—Clause 11.8 of the Programme (as inserted by clause 4) expires with the close of 30 June 2008.
Explanatory Note
This note is not part of the amendment, but is intended to indicate its general effect.
This amendment to the Special Needs Grants Programme extends, until 30 June 2008, the assistance available by way of a
non-recoverable grant to those who need to make essential and immediate repairs or carry out maintenance to on-site effluent
treatment systems. The amendment came into effect on 1 October 2006.
