Under the National Parks Act 1980, the Minister of Conservation revokes the setting apart of that area of Arthur’s Pass National Park described in the Schedule as a wilderness area.

Pursuant to the section 114 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Trevor Knowles, Land Information New Zealand, declares the land described in the Schedule to this notice to be road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, forms part of State Highway No. 49 and remains vested in the Crown on the date of publication of this notice in the New Zealand Gazette.

Public Works Act 1981

Road Realignment—State Highway No. 3, Junction Road Deviation, New Plymouth District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Trevor Knowles, Land Information New Zealand:

(a) Pursuant to section 114, declares the land described in the First Schedule to this notice to be road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, shall become road, limited access road and State Highway No. 1 and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

(b) Pursuant to section 119 (1), declares the land described in the Second Schedule to this notice to be taken as severance and, pursuant to section 119 (4), shall vest in the Crown as stopped government road which, pursuant to section 117 (3) (b), may be dealt with as Crown land under the Land Act 1948.

Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the easement described in the First Schedule to this notice is acquired upon the terms and conditions described in the Second Schedule and shall vest in the Crown (called "the grantee") on the date of publication of this notice in the New Zealand Gazette.

Terms and Conditions

  1. The grantee shall have the right to enter and remain upon the easement land for the purposes of inspecting, maintaining, re-laying, repairing, replacing, or altering the culvert and stilling pond and opening up the soil of the easement land and make any cuttings, trenches and fillings, and to open the same and generally to do and perform such acts or things upon the easement land as may be necessary to enable the grantee to receive the full use and enjoyment of the rights granted to the grantee.

  2. To use the culvert and stilling pond for the purposes of an easement without interruption or impediment.

  3. The grantee will make good any damage to the easement land directly or indirectly arising from the construction of the culvert and stilling pond.
