Regulation 102—Notice of Prohibition of the Importation, Sale, Installation or Use of “BANCO” TPS Cables When its Electrical Overload Protection Exceeds the Rating Applicable to a Cable of V75 Thermal Rating
Pursuant to Regulation 102 of the Electricity Regulations 1997, and acting under delegated authority from the Chief Executive of the Ministry of Economic Development, pursuant to section 41 of the State Sector Act 1988, I, Graham Boxall, Manager, Operations, Ministry of Consumer Affairs, hereby notify that the following electrical fitting, being a TPS cable as described below, is prohibited from importation, sale, installation or use when its electrical overload protection exceeds the rating applicable to a cable of V75 thermal rating.
This prohibition is to take effect on and from the date following the date of publication of this notice in the New Zealand Gazette.
Description
The TPS cable is a flat profile, white sheathed, “Twin and Earth”, building wiring cable of construction similar to that specified in AS/NZS 5000 and having the earth conductor located in the centre position between the phase and neutral conductors. It was supplied with 1.0, 1.5, 2.5 and 4.0 square millimetre conductors.
The TPS cable is “recognisable” by a complete lack of marking on its sheath and was/is supplied on drums marked:
Manufacturer: “BANCO” – Taiwan
Insulation: PVC V90
Sheath: PVC V90
Voltage: 450/750V
This cable was supplied in New Zealand by PoweRun New Zealand Limited (also known as Sheweta Enterprises (NZ) Limited.
Details of Hazard
The cable constitutes or may constitute an electrical hazard in that:
Ɣ when tested for its ageing properties at its marked capacity of V90 rating, the cable becomes brittle indicating that the cable will increasingly function unsafely in normal use, with consequential danger to property from fire, over its lifetime when used at a rating above that applicable to a V75 rated cable.
Reasons for Prohibition
The “BANCO” TPS cable does not comply with the safety requirements of Electricity Regulation 69, in that:
Ɣ the cable, being a fitting, will function unsafely in normal use, so as to cause danger to property from fire.
Accordingly, I issue this prohibition.

Cancellation of Licence for an Early Childhood Centre
Pursuant to Regulation 12 (1) (d) (ii) of the Education (Early Childhood Centres) Regulations 1998, and acting under authority delegated by the Secretary for Education, I hereby cancel the licence dated 20 October 2000, which was granted under those Regulations to Iris McKenzie in respect of Barnardos Early Learning Centre (45032), situated at 8 Maisey Place, Rotorua.
This notice shall take effect the day after the date of its notification in the New Zealand Gazette.

Cancellation of Licence for an Early Childhood Centre
Pursuant to Regulation 12 (1) (d) (iii) of the Education (Early Childhood Centres) Regulations 1998, and acting under authority delegated by the Secretary for Education, I hereby cancel the licence dated 27 June 2001, which was granted under those Regulations to Miranda Spary in respect of Arrowtown Montessori Nursery (80033), situated at 2 Summers Orchard, Arrow Lane, Arrowtown.
This notice shall take effect the day after the date of its notification in the New Zealand Gazette.

Cancellation of Licence for an Early Childhood Centre
Pursuant to Regulation 12 (1) (d) (ii) of the Education (Early Childhood Centres) Regulations 1998, and acting under authority delegated by the Secretary for Education, I hereby cancel the licence dated 19 July 2002, which was granted under those Regulations to Caterina Murphy in respect of Colours Preschool and Education Centre (45010), situated at 18 Francis Street, Whakatane.
This notice shall take effect the day after the date of its notification in the New Zealand Gazette.

Cancellation of Licence for an Early Childhood Centre
Pursuant to Regulation 12 (1) (d) (iii) of the Education (Early Childhood Centres) Regulations 1998, and acting under authority delegated by the Secretary for Education, I hereby cancel the licence dated 26 April 2004, which was granted under those Regulations to Lynette Sclater in respect of Kids Leisure Creche (30182), situated at Meura Street, Matamata.
This notice shall take effect the day after the date of its notification in the New Zealand Gazette.
