Regulations 1999
Fisheries (South Island Customary Fishing) Notice
(No. 61) 2005 (No. F317)
Pursuant to Regulation 10 of the Fisheries (South Island
Customary Fishing) Regulations 1999, a senior fisheries
management advisor of the Ministry of Fisheries (acting
pursuant to a delegated authority in accordance with section
41 of the State Sector Act 1998) hereby gives the following
notice.
Notice
- Title and commencement—(1) This notice may be
cited as the Fisheries (South Island Customary Fishing)
Notice (No. 61) 2005.
(2) This notice shall come into effect the day after the date
of its notification in the New Zealand Gazette.
- Interpretation—In this notice:
(a) “customary food gathering” has the same meaning
as defined in the Fisheries (South Island Customary
Fishing) Regulations 1999.
(b) “Tāngata Tiaki/Kaitiaki” means the person or
persons appointed under Regulation 9 or 10 of
the Fisheries (South Island Customary Fishing)
Regulations 1999 as Tāngata Tiaki/Kaitiaki for the
area/rohe moana.
(c) “area/rohe moana” means the area from the northern
bank of the Hakatere River following the coast to
Ounu Hau Point at Pōhatu, then due east to the limit
of the South Island fisheries waters, then following
the boundary of the South Island fisheries waters to
a point due east of the Hakatere River, and back
to the northern bank of the Hakatere River. The
area/rohe moana excludes Lake Ellesmere (Te
Waihora), as defined as Quota Management Area
ANG13 in the Fisheries Act 1996, and its catchment
and Lake Forsyth (Te Wairewa).

Cancellation of Tāngata Tiaki/Kaitiaki—The Onuku
Rūnanga, being representative of tāngata whenua who
nominated Wiremu (Wi) Tainui as a Tāngata Tiaki/Kaitiaki
for the area/rohe moana, has requested in writing the
cancellation of the appointment of Wiremu Tainui as a
Tāngata Tiaki/Kaitiaki. -
Cancellation of appointment—On 14 December 2004,
the Associate Minister of Fisheries (acting pursuant to
a delegated authority) confirmed the cancellation of the
appointment of Wiremu Tainui as a Tāngata Tiaki/Kaitiaki
for managing customary food gathering within the area/rohe
moana. -
Nomination of Tāngata Tiaki/Kaitiaki—The Onuku
Rūnanga, being representative of tāngata whenua holding
manawhenua manamoana over the area/rohe moana, has
nominated Henare Robinson as a Tāngata Tiaki/Kaitiaki for
the area/rohe moana. -
Appointment of Tāngata Tiaki/Kaitiaki—On
14 December 2004, the Associate Minister of Fisheries
(acting pursuant to a delegated authority) confirmed
the appointment of Henare Robinson as a Tāngata
Tiaki/Kaitiaki for managing customary food gathering
for the area/rohe moana. The appointment is for a term of
five years commencing the day this notice comes into effect. -
Power to authorise taking of fisheries resources for
customary food gathering—The Tāngata Tiaki/Kaitiaki
may authorise any individual to take fisheries resources
managed under the Fisheries Act 1996 for customary food
gathering purposes from within the whole or any part of the
area/rohe moana. No customary food gathering of fisheries
resources may take place in the area/rohe moana without an
authorisation from a Tāngata Tiaki/Kaitiaki.

Closure of the Methodist Burial Ground—Corner
of George Bolt Memorial Drive and Ihumatao
Road, Mangere, Auckland
I, Graeme Richard Gillespie, Group Manager, Communicable
Disease and Environmental Health Policy, Ministry of
Health, acting under delegation from the Minister of Health,
make the following directions under the Burial and Cremation
Act 1964 (“the Act”):

Under section 41 (1) of the Act, the denomination burial
ground known as the Mangere Methodist Burial Ground
situated on the corner of George Bolt Memorial Drive
and Ihumatao Road, Mangere, being the land described
in the Schedule to this notice (“the burial ground”),
shall be closed, subject to the exception and qualification
set out in paragraph 2 below, and burials there shall be
discontinued from and including 1 August 2005. -
This closure notice is subject to the following exception
and qualification:
- The land identified in the Schedule is excluded from
sections 42 and 44 (4) of the Burial and Cremation
Act 1964, and accordingly, the land may be sold and
diverted to any other purpose provided the site is
cleared of any remains, tablets and monuments.
