Charitable Trusts Act Notices

Notice of Approval of a Scheme

In the High Court of New Zealand, Christchurch Registry
In the matter of Part III of the Charitable Trusts Act 1957,
and in the matter of an application by the Manchester Unity Welfare Homes Trust Board for approval of a scheme altering the objects of the Manchester Unity Welfare Homes Trust:

The objects of the trust currently in force state:

“The objects of the Manchester Unity Welfare Homes Trust Board shall be to establish and maintain in Christchurch accommodation for, and to, care for aged people, including the establishment and maintaining of a home for aged people on the land described in the First Schedule hereto and on any other land hereafter acquired by the Manchester Unity Welfare Homes Trust Board.”

The board seeks to amend the objects of the trust by adding as a second object the following:

“Should the land in the First Schedule and any other lands hereafter acquired be sold and after one-half share of the proceeds thereof have been paid to Age Concern Canterbury the remaining one-half share of the proceeds of such sale is to be held by the Manchester Unity Welfare Homes Trust Board in trust to be invested in accordance with the Trustee Act 1956 and the income thereof shall be paid to such charities registered under the Charitable Trusts Act 1957 or the Incorporated Societies Act 1908 and exempt from income tax by the Inland Revenue Department which provide care, services and support for the elderly in Christchurch and Canterbury as shall at the discretion of the Manchester Unity Welfare Homes Trust Board be deserving of assistance and in such proportions as shall be decided by the board.”

The application for approval of the scheme outlined above will be heard in the High Court at Christchurch on the 8th day of February 2006 at 9.30 a.m.

Any person desiring to oppose the application to alter the scheme must give written notice of his or her intention to do so, to the:

(a) Registrar of the High Court at Christchurch; and
(b) Trustees of the Manchester Unity Welfare Homes Trust Board, care of Raymond Donnelly & Co., Barristers & Solicitors, P.O. Box 533, Christchurch (Attention: Philip Shamy); and
(c) Attorney-General, care of the Crown Law Office, P.O. Box 2858, Wellington (Attention: Cheryl Gwyn or Wendy Aldred)

at least seven clear days before the 8th day of February 2006.
