Education Act 1989
The Education (Domestic Students) Notice 2005
Pursuant to section 2 (1) (e) of the definition of the term "domestic student" and section 4A (1) of the Education Act 1989, the Minister of Education gives the following notice.
Notice
- Title and commencement—(1) This notice may be cited as the Education (Domestic Students) Notice 2005.
(2) This notice shall come into force on 1 January 2006.
- Persons to be treated as if they are not foreign students—For the purposes of Parts 1 to 3 and section 79 (2) of the Education Act 1989, foreign students of the following kind, class or description are persons who are required to be treated as if they are not foreign students and who are entitled to enrol at state schools:
The dependent children of any foreign student who is enrolled in any Doctor of Philosophy programme at a New Zealand University.

Notice of Direction for Appointment of a Limited Statutory Manager for the Board of Trustees of Newtown School (2926)
Pursuant to section 78M of the Education Act 1989, I direct the Secretary for Education to appoint a limited statutory manager for Newtown School Board of Trustees because of risks to the operation of the school and to the educational performance of its students.
The following functions, powers and duties of the board are to be vested in the limited statutory manager:
- All functions, powers and duties of the board as an employer (whether statutory or otherwise).
The limited statutory manager must also advise the board on the following:
- Governance roles and responsibilities relating to employment; and
- sound personnel management practice.
This notice takes effect the day after the date of publication.

Pursuant to section 78M of the Education Act 1989, I direct the Secretary for Education to appoint a limited statutory manager for the Riverdale School Board of Trustees because of risks to the operation of the school and the educational performance of its students.
The following functions, powers and duties of the board are to be vested in a limited statutory manager:
- All functions, powers and duties of the board as an employer (whether statutory or otherwise).
This notice takes effect on Friday, 4 November 2005.

The Education (Tertiary Domestic Students) Notice 2005
Pursuant to paragraph (e) of the definition of the term "domestic student" in section 159 (1) of the Education Act 1989, the Minister of Education gives the following notice.
Notice
- Title and commencement—(1) This notice may be cited as the Education (Tertiary Domestic Students) Notice 2005.
(2) This notice shall come into force on 1 January 2006.
- Persons to be treated as if they are not foreign students—For the purposes of Parts 13 to 24 and Schedules 13 to 17 of the Education Act 1989, foreign students of the following class or description are persons who are required to be treated as if they are not foreign students:
A foreign student enrolled for the first time after 19 April 2005 in any Doctor of Philosophy programme at a New Zealand University.
