Notice of Intention to Apply for Approval of Code of Practice

Pursuant to section 79 of the Hazardous Substances and New Organisms Act 1996, the Environmental Risk Management Authority (ERMA New Zealand) gives notice that APD Limited intends to apply for the approval of the Code of Practice for the Design and Construction of Vertical Cylindrical Above Ground Thermoplastic Stationary Tanks for the Storage of Hazardous Liquids with Class 6, 8 and 9 Hazard Classifications.

This code specifies requirements for thermoplastic above ground vertical cylindrical stationary tanks which store toxic, corrosive or ecotoxic liquids that are not flammable.

Under clause 8 (2) (h) of Schedule 8 to the Hazardous Substances (Dangerous Goods and Scheduled Toxic Substances) Transfer Notice 2004, above ground stationary tanks for hazardous liquids must be designed and constructed in accordance with one of the Standards listed in paragraphs 8 (2) (a)-(g) of that Schedule or a code of practice approved by the authority under section 79 of the Act.

Written submissions in relation to the approval of this code can be made by mail, facsimile or email to the contacts below.

Submissions close on 16 September 2005.

A copy of the code can be inspected at the Auckland Office of APD Limited (4/298 Neilson Street, Penrose), or at the Wellington Office of ERMA New Zealand (Level One, BP House, 20 Customhouse Quay).

Land Transport Act 1998

Notice of Proposed Land Transport Rule: Work Time and Logbooks

In accordance with section 161 (2) of the Land Transport Act 1998, Land Transport New Zealand, on behalf of the Minister of Transport, gives notice of his intention to make a Rule concerning work time and logbook use requirements for commercial and heavy vehicle drivers, and advises that draft Land Transport Rule: Work Time and Logbooks (Rule 62001) is now available for public comment.

This proposed rule:

  • establishes a framework for managing driver fatigue;
  • gives effect to the limits on work time prescribed by the Land Transport Act;
  • defines the use of logbooks to record and monitor work time;
  • outlines the process for applying to establish an alternative fatigue management scheme;
  • consolidates and clarifies existing legal requirements, and proposes changes aimed at increasing safety.
