  2. Commercial fishing prohibited area—Commercial fishing within the above mātaitai reserve is hereby prohibited under Regulation 27 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

  3. Power to authorise taking of fisheries resources for customary food gathering—The Tangata Kaitiaki/Tiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1983 and 1996 for customary food gathering purposes from within the whole or any part of the mātaitai reserve. No customary fishing may take place in the mātaitai reserve without authorisation from the Tangata Kaitiaki/Tiaki.

Fisheries (South Island Customary Fishing) Regulations 1999

Fisheries (Declaration of Mātaitai Reserve at Mataura River and Appointment of Tangata Tiaki/Kaitiaki) Notice 2005 (No. F329)

Pursuant to Regulations 20, 21 and 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries hereby gives the following notice:

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Declaration of Mātaitai Reserve at Mataura River and Appointment of Tangata Tiaki/Kaitiaki) Notice 2005.

(2) This notice shall come into effect on the day after the date of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) “mātaitai reserve” means the identified traditional fishing ground described in clause 3 of this notice; and

(b) “Tangata Tiaki/Kaitiaki” means any person or persons appointed as Tangata Tiaki/Kaitiaki for the mātaitai reserve under Regulation 21 of the Fisheries (South Island Customary Fishing) Regulations 1999.

  1. Declaration of a mātaitai reserve—The Minister of Fisheries hereby declares a mātaitai reserve over part of the Mataura River, Southland. The mātaitai reserve encompasses the waters of the Mataura River within:

(a) the northern boundary being a line in an easterly direction across the Mataura River (from a point at 46°10.45′S and 168°53.67′E on the eastern bank to a point at 46°10.45′S and 168°53.87′E on the western bank) about 500 metres upstream of the Mataura tannery; and

(b) the southern boundary being a line in a westerly direction across the Mataura River (from a point at 46°13.96′S and 168°50.97′E on the western bank to a point at 46°13.96′S and 168°51.03′E on the eastern bank) at a bend in the Mataura River about 1 kilometre downstream of Shanks Road.

  1. Appointment of Tangata Tiaki/Kaitiaki—Rewi Whakariri Walter Anglem is hereby appointed as Tangata Tiaki/Kaitiaki for the above mātaitai reserve.

  2. Commercial fishing prohibited area—Commercial fishing within the above mātaitai reserve is hereby prohibited under Regulation 24 of the Fisheries (South Island Customary Fishing) Regulations 1999.

  3. Power to authorise taking of fisheries resources for customary food gathering—The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1983 and 1996 for customary food gathering purposes from within the whole or any part of the mātaitai reserve. No customary fishing may take place in the mātaitai reserve without authorisation from the Tangata Tiaki/Kaitiaki.

Human Assisted Reproductive Technology Act 2004

Approval of Interim Guidelines Under the Human Assisted Reproductive Technology Act 2004

Pursuant to section 83 (2) of the Human Assisted Reproductive Technology Act 2004, the Minister of Health approves the following guidelines as interim guidelines for the Ethics Committee on Assisted Reproductive Technology:

  • National Ethics Committee on Assisted Human Reproduction Guidelines on the Use, Storage and Disposal of Sperm from a Deceased Man;
  • National Ethics Committee on Assisted Human Reproduction Guidelines on Embryo Donation for Reproductive Purposes;
  • National Ethics Committee on Assisted Human Reproduction Guidelines on IVF Surrogacy;
  • National Ethics Committee on Assisted Human Reproduction Guidelines on Within-family Gamete Donation;
  • National Ethics Committee on Assisted Human Reproduction Guidelines on Preimplantation Genetic Diagnosis in New Zealand; and
  • Guidelines on Gamete and Non-viable Embryo Research (sections 15.4, 15.4.1, 15.4.2, 15.5, 15.6, 15.8, 15.10, 15.11, 15.12, 16.3, 16.4, 16.5 and 16.5.1 of the Australian National Health and Medical Research Council’s Ethical guidelines on the use of assisted reproductive technology in clinical practice and research, 2004).

Under section 83 (1) of the Human Assisted Reproductive Technology Act 2004, this approval will expire on 21 November 2007, unless sooner revoked.
