    expires on 31 December 2004.

Introduction

All organisations that seek or receive funding from the
Tertiary Education Commission (TEC) must have an
approved charter unless exempt from the requirement to
have a charter.

Organisations are defined under section 159B of the
Education Act 1989.

Before a body is eligible to have a charter considered for
approval by the Associate Minister or to be exempted from
the requirement to have a charter, the body must first be
identified by the Associate Minister as an organisation for
the purposes of Part 13A of the Education Act 1989, under
section 159B of the Education Act 1989.

Providers of Tertiary Education-related Services

For the purposes of Part 13A of the Education Act 1989,
the Associate Minister identifies the following individual
bodies that provide tertiary education-related services as
organisations within the definition of section 159B (1) (c) of
the Education Act 1989:

  • Tapuae O Rehua
  • Youth Skills New Zealand
  • Otago Youth Wellness Trust
  • National Resource Centre Adult and Community
    Education Aotearoa
  • New Zealand Council of Trade Unions
  • Auckland Regional Migrant Settlement Services Centre
