Conditions

(i) It must be demonstrated that the vehicles comply with the requirements of the Australian Design Rule 35/01 Commercial Vehicle Brake Systems or one of its amended versions.

(ii) The vehicles must be fitted with an Electronic Brake System (EBS) installed by the vehicle manufacturer.

(iii) The EBS must be operational within the tolerances specified by the vehicle manufacturer.

(iv) The brake system of the vehicles must not be modified in any way.

(v) The brake system of the vehicles must be maintained as specified by the vehicle manufacturer.

(vi) Any components, including but not restricted to valves, sensors, relays, fittings and brake friction materials, that are fitted to the brake system of the vehicles during maintenance or repair must be supplied or approved by the vehicle manufacturer.

(vii) The vehicles must continue to comply with the requirements of the Regulation in clause (1) and the requirement in clause (2) to (4).

(viii) A Statement of Compliance with the requirements in clauses (1) to (4) must be issued for each exempted vehicle by the authorised agent of the vehicle manufacturer, and it must require continuous compliance with the conditions of this exemption.

(ix) The Statement of Compliance in clause (8) is sufficient means of verification of compliance with a standard, alternative to the one required in Regulation 16A (1) (b) of the Heavy Motor Vehicle Regulations 1974.

(x) A copy of the Statement of Compliance in clause (8), together with every relevant supporting information and document, must be kept by the person who issued it, and one copy of the Statement of Compliance must be provided to the registration organisation and to the operator of the vehicle.

(xi) This exemption may be revoked at any time.

Pursuant to section 166 (3) of the Land Transport Act 1998, I, John Glyde Kay, General Manager, Operations, Land Transport Safety Authority, notify the following exemptions from Land Transport Rules were made under section 166 (1) of that Act between 1 January 2004 and 31 March 2004:
