Advertisement of Application for Putting Company into Liquidation

Take notice that on the 6th day of April 2004, an application for putting Carlton Hotel Limited into liquidation by the High Court was filed in the High Court at Christchurch.

The application is to be heard before the High Court at Christchurch on the 17th day of May 2004 at 10:00 a.m.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.

The plaintiff is the Commissioner of Inland Revenue, whose address for service is Technical and Legal Support Group, South Island Service Centre, First Floor, 165 Cashel Street (P.O. Box 1782), Christchurch. Telephone: (03) 363 1577. Facsimile: (03) 363 1519.

Land Transfer Act Notice

The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the partial removal of an easement. The applicants claim that part of the easement is redundant by reason of the circumstances set out below. I intend to remove that part of the easement on the 10th day of June 2004, if no objections have been received before that date.

Applicants: Stephen Sydney Palmer and Berenice Cristian Franca Palmer.

Description of Easement: Right of way and rights to convey water, electricity, telecommunications, computer media and to drain water and sewage over part marked “F” and to convey electricity, telecommunications and computer media over part marked “D” on DP 326823, being part Lot 3, DP 326823 (comprised in Computer Register 108848) appurtenant to (now) part Lot 19, DP 332035 (comprised in Computer Register 131487) created by easement instrument 5786950.7.

Circumstances: Part of the dominant tenement (now part Lot 19, DP 332035) owned by Stephen Sydney Palmer and Berenice Cristian Franca Palmer has become physically separated from the servient tenement (owned by Nelson Street Bible Chapel) as a result of subdivision.

Notice of Appointment of Statutory Managers

John Anthony Waller and Richard Dale Agnew were appointed statutory managers of the above-named entities on the 3rd day of July 2003 at 4.00 p.m., by Order in Council under section 38 of the Corporations (Investigation and Management) Act 1989 (“the Act”).

Notice to Creditors/Investors to Claim

Notice is given that the statutory managers hereby fix Thursday, the 27th day of May 2004, as the last day on or before which the creditors/investors of the entities are to make their claims and to establish any priority their claims may have or to be excluded from the benefit of any distribution made before the debts are claimed or, as the case may be, from objecting to the distribution.

No further extensions will be granted.

Creditors/investors of the entities who have claimed previously do not need to claim again.

Notice of Court Proceedings

Notice is further given that the statutory managers have issued proceedings in the High Court at Auckland under CIV-2004-404-1868 seeking directions, pursuant to sections 58 and 59 of the Act, as to the method of distribution of the assets of International Investment Unit Trust (in statutory management).

Any person who has filed a proof of debt or who files a proof of debt by the 27th day of May 2004 in International Investment Unit Trust (in statutory management), will be sent by post a copy of the originating application to the address set out in the proof of debt.

A copy of the affidavit in support of the originating application can be viewed at the address set out below.
