Making of a Recommendation Concerning the Electricity Governance Rules – Rule Amendment Proposal No. 14
This notice of a recommendation concerning the Electricity Governance Rules (“Rules”), Rule Amendment Proposal No. 14, is issued by the Electricity Commission (“Commission”), established under the Electricity Act 1992 (“Act”), pursuant to section 172E (2) (c) of the Act.
Section 172E (2) (c) provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy, the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.
Recommendation
The Commission made a recommendation that Rule 3.1 of Code of Practice D3, Schedule D1, Part D of the Rules be amended, in reliance on section 172F (3) (effect of recommendation is minor), on 7 December 2004.
Section 172F (3) provides that the Commission is not required to comply with section 172F (1) (assessment) if it is satisfied that the effect of the recommendation is minor and will not adversely affect the interests of any person in a substantial way.
Accordingly, no such assessment has been carried out.
Recommended Amendment to the Rules
The recommended amendment to Rule 3.1 of Code of Practice D3, Schedule D1, Part D of the Rules, was the deletion of the words that outline that work that may have an effect on any components of a metering installation, but do not affect accuracy, will only be permitted to be carried out by the employees or subcontractors of an approved test house.
Additional wording was also recommended to clarify that components of a metering installation, including auxiliary equipment and wiring, may be installed by suitably qualified personnel, other than employees and subcontractors employed by an approved test house.

The Commission made a recommendation that Rule 5.1.3 of Code of Practice G1, Schedule G8, Part G of the Rules, be deleted and replaced with new Rules 5.1.3, 5.1.3A and 5.1.3B, in reliance on section 172F (3) (effect of recommendation is minor), on 7 December 2004.
Section 172F (3) provides that the Commission is not required to comply with section 172F (1) (assessment) if it is satisfied that the effect of the recommendation is minor and will not adversely affect the interests of any person in a substantial way.

Recommended Amendment to the Rules
The recommended amendment was the deletion of 5.1.3 from, and the insertion of new Rules 5.1.3, 5.1.3A and 5.1.3B into Code of Practice G1, Schedule G8 of Part G, to remove ambiguity in the Rules, enable consistency in reporting, and ensure that the results can be meaningfully used as a basis for seeking improvements.
The proposed amendments also recognise that there are some meters that are either unsafe or unable to be accessed by a retailer despite best endeavours.

Notification of Ordinary Rules
Pursuant to section 161 (3) of the Land Transport Act 1998, notification is hereby given of the making of Land Transport (Road User) Rule (Rule 61001), Land Transport Rule: Traffic Control Devices (Rule 54002) and Land Transport Rule: Vehicle Lighting (Rule 32005).
These rules will come into force on 27 February 2005.
These ordinary rules are available for inspection free of charge at the Head Office of Land Transport New Zealand, 7-27 Waterloo Quay, Wellington, and for purchase in December 2004 at bookshops that sell legislation.
Copies of Land Transport Rule: Traffic Control Devices and Land Transport Rule: Vehicle Lighting in bound and loose-leaf format, and Land Transport (Road User) Rule in loose-leaf format, are available direct from Wickliffe Limited, P.O. Box 932, Dunedin.
Copies of Land Transport (Road User) Rule in bound format can be obtained from Legislation Direct, P.O. Box 12-357, Wellington.
