Notice of Application to Vary Terms of a Charitable Trust

In the High Court of New Zealand, New Plymouth Registry

In the matter of the Charitable Trusts Act 1957, and in the matter of an application by the Pukeiti Trust Fund—

And—Pukeiti Rhododendron Trust—Interested party:

Take notice that the trustees of the Pukeiti Trust Fund will apply to the High Court at New Plymouth on Wednesday, the 3rd day of November 2004 at 9.00 a.m., for an order varying the terms of the Pukeiti Trust Fund deed dated the 29th day of October 1971, as varied by order of the High Court on the 10th day of September 1998.

The purpose of this application is to vary the Pukeiti Trust Fund deed’s investment power and other minor alterations.

Further particulars of the application may be obtained from the office of the applicant’s solicitors, Govett Quilliam.

Any person desiring to oppose the scheme is required to give notice in writing of his/her intention to do so to:

(a) the Registrar of the High Court at New Plymouth (Attention: Tasha Kupe);

General Use Claim:
A preparation of the non-pathogenic bacterium Pantoea agglomerans for the prevention of fire blight infection of pip fruit flowers.

Any person may make a written submission to the Director-General under section 17 of the ACVM Act 1997 concerning any application notified above.

Such submissions:

(a) must state in full the reasons for making the submission;

(b) may state any decision sought on that application;

(c) must be received by the Director-General no later than 30 working days after the date of notification in the New Zealand Gazette; and

(d) should be forwarded to the address given below.

A copy of every submission will be forwarded to the applicant for their information.
