Exchange of Reserve for Other Land
Pursuant to the Reserves Act 1977, and to a delegation from
the Minister of Conservation, the Manukau City Council
hereby authorises the exchange of the land described in
Schedule A hereto at Ngati Otara Park for the land described
in Schedule B hereto at Sir Edmund Hillary Collegiate.

6417 square metres, more or less, being Lot 4, D.P. 314395,
formerly part Lot 185, D.P. 50993, part certificate of title
2110/99.
Schedule B
North Auckland Land District—Manukau City
6417 square metres, more or less, being Lot 1, D.P. 31495,
formerly part Lot 184, D.P. 50993, Gazette Notice 19536.

Appointment of Fish and Game New Zealand,
Eastern Region to Control and Manage
Part of a Government Purpose (Wildlife
Management) Reserve
Under the Reserves Act 1977, the Community Relations
Manager for the Bay of Plenty Conservancy of the
Department of Conservation hereby appoints Fish and
Game New Zealand, Eastern Region, to control and manage
that part of the Kapenga Wildlife Management Reserve
described in the Schedule.
The appointment to control and manage the said part of the
Wildlife Management Reserve is effective from the date this
New Zealand Gazette notice is signed.
The appointment to control and manage the reserve will
apply for the period over which the Department of
Conservation leases the land as a reserve from the trustees
of the Kapenga M Trust.
The appointment to control and manage will be reviewed
after 10 years if the Department still retains the lease.
Fish and Game New Zealand, Eastern Region (“F&GNZ”),
is required to comply with the following general provisions
relating to the administration of the reserve:
(a) F&GNZ will obtain any resource consents required
by the Resource Management Act 1991 before any
activity is carried out on that part of the reserve area
that is controlled and managed by F&GNZ.
(b) F&GNZ will comply with the Department of
Conservation’s Environmental Care Code and
Water Code.
(c) F&GNZ will comply with the terms and conditions
of the department’s lease agreement with the trustees
of the Kapenga M Trust including those terms and
conditions contained in a variation to the original
lease agreement made with the trust.
(d) F&GNZ will present an annual work plan to the
Department of Conservation in January of each year
setting out any work that F&GNZ intends to
undertake during that year.
(e) Department of Conservation staff will have access to
that part of the reserve controlled and managed by
F&GNZ for management and monitoring purposes
at all times.

(f) No indigenous vegetation is to be cut or removed
and no planting of exotic vegetation shall occur on
that part of the reserve controlled and managed by
F&GNZ without prior written authorisation from the
Manager of the Department’s Rotorua Lakes Area
Office.
(g) Firearms and dogs are not permitted in that part of
the reserve controlled and managed by F&GNZ,
except for the purpose of hunting during the game
bird-hunting season or for reserve management
purposes. Hunting dogs must be registered and must
be strictly controlled at all times.
(h) No fires shall be lit in that part of the reserve
controlled and managed by F&GNZ without the
prior written authorisation of the Manager of
the Department’s Rotorua Lakes Area Office. The
Department of Conservation shall be responsible for
fighting fires on that part of the Reserve controlled
and managed by F&GNZ but F&GNZ will assist the
department in the event of any fire outbreak.
(i) F&GNZ and the Department of Conservation will
each pay a one quarter share in the cost of
renovation and maintenance of any boundary
fencing on or around that part of the reserve
controlled and managed by F&GNZ.
(j) F&GNZ and the Department of Conservation will
jointly prepare a management strategy for that
part of the reserve controlled and managed
by F&GNZ. The management strategy will be
completed by 31 December 2004 and will form the
basis of a management agreement between the two
organisations.

86.4468 hectares, situated in Block XII, Horohoro Survey
District and Block IX, Tarawera Survey District, being part
Kapenga M Block, M.L. 20819; marked “A” and “B” on
S.O. Plan 61819.

Revocation of the Reservation Over a Reserve
Specifying the Manner of Disposal and How to
Utilise Proceeds of Sale
Under the Reserves Act 1977, the Community Relations
Manager for the Bay of Plenty Conservancy of the
Department of Conservation revokes the reservation over
that part of the local purpose (esplanade) reserve described
in the Schedule and declares that the land may be disposed
of by the Whakatane District Council for amalgamation into
the title of adjoining property at a price or other
consideration and on terms and conditions as the council
determines, with any net proceeds of sale to be paid into the
council’s general funds.
