Advertisement of Application for Orders Under Section 174 of the Companies Act 1993

Take notice that on Friday, the 6th day of December 2002, an application for orders, under section 174 of the Companies Act 1993, in respect of Maison Rouge Limited was filed in the High Court at Christchurch.

The orders sought are:

(a) Barry Wilson sell his shares to Aileen Kay Ginders and Richard Stewart Ginders at a price to be determined by an independent valuer to be approved by the Court; and

(b) Barry Wilson pay compensation to Maison Rouge Limited in the sum of $12,131.38.

The application is to be heard before the High Court at Christchurch on Monday, the 17th day of February 2003 at 10.00 a.m.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.

The plaintiffs are Aileen Kay Ginders and Richard Stewart Ginders, whose address for service is at the offices of Duncan Cotterill, Solicitors, Level Nine, Clarendon Tower, corner of Worcester Street and Oxford Terrace, Christchurch.

I am in receipt of application 5450221.1 by David Gould Russel Short, solicitor of Auckland, as lessor under lease B. 436665.4 (Computer Interest Register 11893).

That lease is registered for a term of 12 years from the 20th day of August 1994 and is registered over Lot 3 and Lots 9 and 10, D.P. 643 (Computer Freehold Register/certificate of title WN31C/792).

The lessee is Yendor Limited.

The application is lodged, under section 121 of the Land Transfer Act 1952, on the grounds that the lessor has exercised his right of re-entry and recovered possession of the leased premises.

It is my intention to notify this re-entry in the Register on the 14th day of March 2003.

Please note that such action shall cause the estate of the above-named lessee to cease and determine along with the interest of any person claiming through or under that lessee.
