Persons Ineligible to be Trustees

A person cannot be a member of a school board of trustees who:

  • is a permanent employee of the school board (except by being elected as the staff representative); or

  • is a mentally disordered person; or

  • is a bankrupt who has not yet obtained a discharge; or

  • is not a New Zealand citizen (unless they have been given approval, or are entitled to reside in New Zealand for more than 12 months); or

  • has been convicted of an offence (for which the person could have been sent to prison) and has not been sentenced for the offence, or has been sentenced for it and has not:

    i. received a full pardon; nor

    ii. suffered the penalty imposed.

A returning officer is ineligible to be nominated as a candidate in the election they are the returning officer for.

A person who has a contract, or contracts with a board which exceed/s $25,000 in a financial year [unless the board obtains the approval of the Secretary for Education] is also ineligible to be nominated as a candidate for the board they have the contract/s with.
