Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister for Land Information, R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the Schedule to this notice is acquired for road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, shall become road, limited access road and State highway and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

Declaring Land Taken for Water Works, a Right of Way Easement and a Right to Convey Water—Block I, Rimutaka Survey District, Pinehill Crescent, Upper Hutt City

Pursuant to section 50 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, R. J. Sutherland, Land Information New Zealand, declares that, a sufficient agreement to that effect having been entered into on 24 January 1990 between Her Majesty the Queen (in this notice referred to as the grantor) and the Upper Hutt City Council (in this notice referred to as the grantee), the land described in the First Schedule hereto is hereby taken for water works and shall vest in the Upper Hutt City Council, together with:

(a) A right to convey water over the land described in the Second Schedule hereto, appurtenant to the land described in the First and Third Schedules hereto, such right to be in accordance with paragraph 2, together with the additional rights in paragraph 5 of the Seventh Schedule to the Land Transfer Act 1952; and

(b) A right of way easement over the land described in the Second Schedule hereto, appurtenant to the land described in the First and Third Schedules hereto, such right to be in accordance with paragraph 1, together with the additional rights in paragraph 5 of the Seventh Schedule to the Land Transfer Act 1952, and subject to the following condition, namely:

Maintenance of Right-of-Way

1. The grantor shall be solely responsible for the maintenance of that part of the right-of-way as consists of:

   • area “N” on S.O. Plan 37223; and
   • that part of area “B” on S.O. Plan 35634 as forms part of the formed and sealed road access from the Pinehill Crescent/Freyberg Road intersection to the Rimutaka Prison compound.

2. The grantee shall be solely responsible for the maintenance of the balance of the right-of-way.
