Order of the Council in Disciplinary Session in Respect of a Psychiatric Nurse
After due inquiry and in exercise of its powers under sections 42 (1) (b), 42 (2) (a), 42 (3) and 48A of the Nurses Act 1977, the Nursing Council of New Zealand (“the council”), in a decision dated 18 December 2001, found Mark Gregory Mitchell, registered psychiatric nurse, guilty of professional misconduct on the grounds that his conduct brings or was likely to bring discredit on the nursing profession and amounted to malpractice.
The council ordered that Mark Gregory Mitchell’s name be removed from the Register and that he may reapply for reinstatement after 12 months.
It also ordered that he pay $4700.00 (being 50%) towards the actual costs and expenses of and incidental to the investigation and prosecution by the Preliminary Proceedings Committee and inquiry by the council, and that a notice stating the effect of these orders be published in the New Zealand Gazette, Kai Tiaki: Nursing New Zealand and the nursing council’s newsletter with the names of the complainant and witnesses suppressed.

After due inquiry and in exercise of its powers under sections 42 (1) (b), 42 (2) (a), 42 (3) and 48A of the Nurses Act 1977, the Nursing Council of New Zealand (“the council”), in a decision dated 18 December 2001, found Awhina Teresa MacDonald, registered psychopaedic nurse, guilty of professional misconduct on the grounds that her conduct brings or was likely to bring discredit on the nursing profession and amounted to malpractice.
The council ordered that Awhina Teresa MacDonald’s name be removed from the Register and that she may reapply for reinstatement after 12 months.
It also ordered that she pay $7770.00 (being 40%) towards the actual costs and expenses of and incidental to the investigation and prosecution by the Preliminary Proceedings Committee and inquiry by the council, and that a notice stating the effect of these orders be published in the New Zealand Gazette, Kai Tiaki: Nursing New Zealand and the nursing council’s newsletter with identifying details of the case are suppressed.

After due inquiry and in exercise of its powers under section 42 (1) (b), 42 (2) (a), 42 (3) and 48A of the Nurses Act 1977, the Nursing Council of New Zealand (“the council”), in a decision dated 19 December 2001, found Wendy Fay Niblett, registered comprehensive nurse, guilty of professional misconduct on the grounds that her conduct brings or was likely to bring discredit on the nursing profession.
The council ordered that Wendy Fay Niblett’s name be removed from the Register and that she may reapply for reinstatement after 12 months.
It also ordered that she pay $2470.00 (being 50%) towards the actual costs and expenses of and incidental to the investigation and prosecution by the Preliminary Proceedings Committee and inquiry by the council, and that a notice stating the effect of these orders be published in the New Zealand Gazette, Kai Tiaki: Nursing New Zealand and the nursing council’s newsletter with details made available to the press on request.
