Notice of Intention to Take Land for Road—Coal Haulage Road, Rotowaro, Waikato District

Pursuant to section 23 of the Public Works Act 1981, notice is hereby given that the Waikato District Council proposes to take the land described in the Schedule hereto (“the land”):

• The land is required for a public work by the Waikato District Council to form part of Coal Haulage Road at Rotowaro.
• The intended taking is considered reasonably necessary for the continuity and safe and convenient use of an important strategic road.
• The formed proposed road is situated between 2 coal mining seams that have been mined or are being mined at present under a coal mining permit.
• The current route is the only possible route on a stable foundation that is unaffected by mining.
• The owners of the land and those persons with a registered interest in it have been served with notice of the Waikato District Council’s intention to take the land and advised of their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, P.O. Box 5027, Wellington, within 20 working days after the service of this notice.

If any objection is made in accordance with this notice, a public hearing will be held.
The objector will have the right to appear and be heard personally unless the objector otherwise requires.
Each objector will be advised of the time and place of the hearing.

The land to be taken is formed and in use as Coal Haulage Road, Rotowaro, 8 kilometres from Huntly West.
A copy of the plan may be viewed at the council offices at Ngaruawahia.

Reserves Act 1977

Revocation of a Notice Relating to a Reserve and Issue of Fresh Notice

Under section 6 (3) of the Reserves Act 1977, and by reason of errors made in the notice described subsequently, the Community Relations Manager revokes the notice headed Classification of Reserve dated the 18th day of December 2001 and published in the New Zealand Gazette, 10 January 2002, No. 1, page 75, and issues the following notice as a fresh notice in its place.

Classification of Reserve

The Community Relations Manager for the Wanganui Conservancy of the Department of Conservation classifies the reserve described in the Schedule as scenic reserve, for the purposes specified in section 19 (1) (a) of the Reserves Act 1977, subject to the provisions of the Act.

Declaration That Land is a Reserve

Under the Reserves Act 1977, the Community Relations Manager of the Northland Conservancy of the Department of Conservation notifies that the following resolution was passed by the Far North District Council on 13 February 2002:

“In exercise of the powers conferred on it by section 14 of the Reserves Act 1977, the Far North District Council hereby resolves that the land held by the council in fee simple, and described in the Schedule be declared to be a recreation reserve.”

Pursuant to the Reserves Act 1977, and a delegated authority from the Minister of Conservation, the Porirua City Council hereby gives notice that a resolution to the following effect was passed by the council on 12 December 2001:

“That pursuant to section 14 (1) of the Reserves Act 1977, council hereby resolves that the land held by the city in fee simple, as described in Schedule 1, be declared to be local purpose reserve (neighbourhood) for the purpose specified in section 23 of the Act.”
