Land Exchange Between the Wellington Regional Council and The Hutt City Council at High Street, Lower Hutt

Pursuant to the Public Works Act 1981 (“the Act”) and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand, declares that, under a written agreement dated 29 March 1995, between the Wellington Regional Council (“WRC”) and The Hutt City Council (“HCC”):

(a) the HCC land described in the First Schedule is hereby acquired for soil conservation and river control purposes and is vested in WRC, under sections 50 and 20 of the Act, from the date of publication of this notice in the New Zealand Gazette;

(b) the HCC land described in the Second Schedule is declared to be road and will remain vested in HCC, under section 114 of the Act, from the date of publication of this notice in the New Zealand Gazette; and

(c) the WRC land described in the Third Schedule is hereby acquired for road and is vested in HCC, under sections 50 and 20 of the Act, from the date of publication of this notice in the New Zealand Gazette.

Land Acquired for a Scenic Reserve—Dickeys Road, Belfast, Christchurch City

Pursuant to sections 20 (1), 28 and 48 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, R. J. Sutherland, Land Information New Zealand, declares that, an agreement to that effect having been entered into:

(a) The land described in the First Schedule hereto is hereby acquired for a scenic reserve, subject to the Reserves Act 1977, and shall vest in the Christchurch City Council on the date of publication hereof in the New Zealand Gazette.

(b) A right of way easement described in the Second Schedule is hereby acquired over the land described in the Third Schedule to be held forever appurtenant to the land firstly described in the First Schedule hereto on the date of publication hereof in the New Zealand Gazette.

(c) A right of way easement described in the Fourth Schedule is hereby acquired over the land described in the Fifth Schedule to be held forever appurtenant to the land secondly described in the First Schedule hereto on the date of publication hereof in the New Zealand Gazette.

(d) A right to water stock described in the Sixth Schedule is hereby granted over the land described in the Seventh Schedule to be held forever appurtenant to the land described in the Eighth Schedule hereto on the date of publication hereof in the New Zealand Gazette.

Description of Right of Way Easement (Public Access)

The full, free, uninterrupted, and unrestricted right, liberty, and privilege for the grantee, its servants, tenants, agents workmen, licensees and invitees (in common with the grantor, its tenants and any other person lawfully entitled so to do) from time to time and at all times by day and by night.
