Notice

1. Title—This notice may be cited as the Local Government (Marlborough District and Tasman District) Boundary Alteration Notice 2002.

District Boundaries

2. Boundary alteration—The boundaries of Marlborough District and Tasman District are altered by excluding the areas described in the Schedule to this notice from Marlborough District and including them in Tasman District.

3. Wards—The areas described in the Schedule to this notice cease to form part of the Wairau Ward of Marlborough District and form part of the Lakes-Murchison Ward of Tasman District.

Regional Boundaries

4. Regional boundaries—For the purpose of clarity it is noted that:

   (a) Section 37O (3) of the Local Government Act 1974 provides that “where the boundaries of a district that are the same as the boundaries of any part of a region are altered, the alteration shall have effect with respect to the region, and the boundaries of the region shall be deemed to be altered accordingly”;

   and

   (b) In accordance with section 37O (3), the areas included in Tasman District by this notice cease to form part of the Marlborough Region and form part of the Tasman Region.

Transitional Matters

5. General—Part II of Schedule 3B to the Local Government Act 1974 applies to this notice as if it were an Order in Council giving effect to a reorganisation scheme prepared under that Act.

Schedule

Areas Excluded From Marlborough District and Included in Tasman District

Firstly—Those parts of the following areas situated in Marlborough District:

• Lot 8, D.P. 16183, Nelson Land District.
• Lot 9, D.P. 16183, Nelson Land District.
• Lot 10, D.P. 16183, Nelson Land District.
• Section 1, S.O. 14997, Nelson Land District.
• Part Lowther Road.

Secondly—That part of State Highway No. 63 adjacent to Section 1, S.O. 14997, bounded by a line commencing at the south-eastern corner of Section 1 and being a projection of the eastern boundary of Section 1 to the middle line of State Highway No. 63, then following the boundary between the Marlborough District and the Tasman District in a westerly and northerly direction to its intersection with the southern boundary of Section 1, then following the southern boundary of Section 1 to the point of commencement.\n

Public Works Act 1981

Notice of Intention to Take Land for Road—State Highway No. 3, near Waipuku Bridge

Pursuant to section 23 of the Public Works Act 1981, notice is hereby given that the Crown proposes to take the land described in the Schedule hereto (“the land”):

• The land is required for road and it is intended to use the land to form part of State Highway No. 3.
• The intended taking is considered reasonably necessary for the safe and convenient use of the road.
• The realignment of the road adjoining the land has been constructed and the land to be taken forms an integral part of the road.
• The land use is in accordance with the designation under the district plan.
• The owner of the land and those persons with a registered interest in it have been served with notice of the Crown’s intention to take their land and their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, P.O. Box 5027, Wellington, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice a public hearing will be heard with the right of the objector to appear and be heard personally unless the objector otherwise requires and each objector will be informed of the time and place of the hearing.

New Plymouth Land District—Stratford District

(a) 123 square metres; shown as “Section 9” on S.O. Plan 14780, being part of part Section 9, Town of Waipuku, and being part of the land contained in certificate of title 21/141.

(b) 78 square metres; shown as “Section 4” on S.O. 14865, being part Section 9, Town of Waipuku, and being part of the land contained in certificate of title 21/141.

The land to be taken adjoins State Highway No. 3 south of Jones Street at Waipuku.

Vesting Stopped Road—Rodney District Council

Pursuant to section 117 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand, declares the portion of stopped road described in the Schedule to this notice shall be amalgamated with the land in certificate of title 913/279.
