(a)

for code-share services, operate over the route "Points in New Zealand, optionally via any point/s (excluding Mainland China and Taiwan), to Hong Kong, and optionally beyond to any point/s (excluding Mainland China and Taiwan)";

(b)

for own-aircraft services, operate capacity of up to 7 frequencies per week with any aircraft type; and

(c)

for code-share services (where Air New Zealand is the marketing carrier), offer such capacity as is filed with and acknowledged by the Secretary for Transport, with the note that fifth freedom and stopover traffic rights may not be exercised between Hong Kong and either the intermediate or beyond points.

Any person or organisation wishing to make representations to the Minister of Transport relating to this application must forward those representations in writing to reach me at the Ministry of Transport, P.O. Box 3175, Wellington, on or before 14 March 2002.

Background:

(a) On 13 December 2001, an old gold mine collapsed in Waihi, damaging or endangering a number of nearby homes.

(b) The Crown has agreed to make ex-gratia payments to 12 home owners whose homes were damaged or endangered by the collapsed gold mine.

(c) Ex-gratia payments will be based on an assessment of the damage or endangerment caused by the collapsed gold mine as if the damage or endangerment were caused by a natural disaster as defined in the Earthquake Commission Act 1993.

(d) The Minister wishes to confer the function of carrying out such assessments on the Earthquake Commission.

Now therefore:

  1. Pursuant to section 5 of the Earthquake Commission Act 1993, I, the Honourable Dr Michael John Cullen, Minister of Finance, hereby give notice that the following functions will be conferred on the Earthquake Commission:

    (i)

    To investigate 12 homes (as set out in Appendix A) (the “homes”) damaged or endangered by the collapse of the gold mine in Waihi on 13 December 2001.

    (ii)

    To assess the damage or endangerment to the 12 homes in Waihi caused by the collapse of the gold mine in Waihi (the “assessment”). Assessments will be conducted as if that damage or endangerment were caused by a natural disaster as defined in the Earthquake Commission Act 1993.

    (iii)

    To provide the Treasury with the results of the assessments and advise the amounts to be paid by the Crown ex-gratia.

    (iv)

    To advise the Minister of Finance about any other matters relating to the assessments as requested from time to time.

  2. This notice comes into effect on and from the date of execution.

Notice of Intention to Consider Varying a Scheduled International Air Service Licence

Pursuant to section 87J (3) of the Civil Aviation Act 1990, and section 41 of the State Sector Act 1988, and a delegation from the Secretary for Transport dated 29 March 2000, I give notice that, having received an application from Air New Zealand Limited, the Minister of Transport intends to consider varying the Scheduled International Air Service Licence held by that airline in order that it may operate:

Route:

Points in New Zealand, optionally via intermediate points, to points in Thailand, and optionally to points beyond.

Capacity:

Unlimited capacity with third and fourth freedom traffic rights;
Fifth freedom traffic rights may be exercised on up to 21 frequencies per week with any aircraft type.

Any person or organisation wishing to make representations to the Minister of Transport relating to this application must forward those representations in writing to reach me at the Ministry of Transport, P.O. Box 3175, Wellington, on or before 14 March 2002.
