  1. This direction recognises both the decisions in (1) above and the Northland and East Cape councils’ financial situations outlined in (2) above. The Government also agreed that, while this direction requires Transfund New Zealand to provide 100% funding for regional development roads and alternatives to roading for the named councils, those councils’ overall contributions to land transport investment is to be maintained.

Officers of the Government of Ross Dependency Appointed

Background:

A. An Order in Council dated 30 July 1923* (“the order”) made under the British Settlements Act 1887 (UK) appoints the Governor-General of New Zealand to be the Governor of the Ross Dependency (“the Governor”) and vests in the Governor certain powers:

B. The order empowers the Governor to make rules and regulations for the peace, order, and good government of the Dependency:

C. Regulations made by the Governor on 14 November 1923† provide that all persons appointed by the Governor may be empowered to do such things as may be necessary or desirable to ensure that the laws in force in the Dependency are duly observed and complied with in every respect, and to do all things necessary or expedient for the peace, order, and good government of the Dependency, and to safeguard and preserve Her Majesty’s rights and sovereignty over and in respect of the Dependency:

D. It is now expedient that Peter James Brookman and Dene Peter Robinson be appointed officers of the Government of the Dependency:

Now therefore I, Dame Silvia Cartwright, the Governor-General of New Zealand, and as such the Governor of the Dependency, appoint

to be officers of the Government of the Dependency while they act as Senior New Zealand Representatives at Scott Base during the period beginning with this appointment and ending with the close of 30 September 2005.

I confer on Peter James Brookman and Dene Peter Robinson, while they hold office as officers of the Government of the Dependency, all the powers exercisable in New Zealand by a Justice of the Peace, and also the powers exercisable in New Zealand by a Coroner.

Peter James Brookman and Dene Peter Robinson are to exercise their functions at such places within the Dependency as may be directed by an officer of the Government of the Dependency who has the general executive and administrative authority in preserving Her Majesty’s rights and sovereignty and the laws in force in the Dependency.

As witness the hand of Her Excellency the Governor-General as the Governor of the Ross Dependency, this 15th day of October 2002.

Heavy Motor Vehicle Regulations 1974

Exemption From Requirements of Heavy Motor Vehicle Braking Regulations

Pursuant to Regulation 16A (2) of the Heavy Motor Vehicle Regulations 1974, and pursuant to the powers delegated to me by the Director of Land Transport Safety, I, Laszlo Andras Hidvegi, Senior Engineer Safer Vehicles Policy, hereby exempt the vehicles specified in Schedule 1 of this notice from the requirement in Schedule 2, subject to the conditions specified in Schedule 3.

  1. Regulation 16A (1) (b) of the Heavy Motor Vehicle Regulations 1974, requiring vehicles to comply with the Interim Performance Specifications for Heavy Vehicle Braking.
  2. The requirement to comply with the New Zealand Heavy Vehicle Brake Code that has been approved in accordance with Regulation 16A (2) of the Heavy Motor Vehicle Regulations 1974 as an alternative standard to the Interim Performance Specifications for Heavy Vehicle Braking.

Schedule 3
(i) The brake system of the vehicle must continue to comply with the Australian Design Rule 35/01.

(ii) The brake system, which is an Electronic Brake System (EBS) that also has Anti Lock Braking System (ABS) and Anti Slip Regulation (ASR) functions, must be operational within the tolerances specified by the vehicle manufacturer.

(iii) The brake system of the vehicle must not be modified in any way.

(iv) The brake system of the vehicle must be maintained as specified by the vehicle manufacturer.

(v) Any components, for example valves, sensors, relays, fittings, brake friction materials etc. that are
