Will of Edward Durning Holt

Notice of Application for Approval of a Scheme Varying the Terms of a Trust

Under Part III of the Charitable Trusts Act 1957

Notice is hereby given that the trustees of the will of Edward Durning Holt, farmer of Napier (deceased), have filed in the office of the High Court at Napier an application for approval of a scheme varying the terms of the trust in which the deceased’s residuary estate is held.

Under the will, the trustees were to hold certain shares for the benefit of:

  • Napier Community Trust Hospital, for the general charitable purposes of the Princess Alexandra Hospital,
  • The Presbyterian Social Services Association of Hawke’s Bay and Poverty Bay Incorporated, for the general charitable purposes of its Atawhai Homes at Taradale, and
  • St Michael’s and All Angels Anglican Church, Puketapu, for the general charitable purposes of that church.

The trustees seek to vary the terms of the said will by making the following substitutions:

  • Cranford Hospice, in place of Napier Community Trust Hospital;
  • Presbyterian Support Services – East Coast, in place of The Presbyterian Social Services Association of Hawke’s Bay and Poverty Bay Incorporated; and
  • Waiapu Diocesan Board of Trustees, for the benefit of St Michael’s and All Angels Church, Puketapu parishioners.

Copies of the proposed variation scheme and the report of the Attorney-General thereon may be inspected free of charge at the office of the Registrar of the High Court at Napier or at the office of the Solicitor for the Trustees, Guardian Trust Building, Station Street, Napier.

The application has been set down for hearing in the High Court at Napier on the 3rd day of September 2001 at 9.30 a.m.

Any person desiring to oppose the scheme is required to give written notice of his or her intention to do so to the Registrar of the High Court at Napier and to the solicitor for the trustees, Guardian Trust Building, Station Street, Napier, and to the Attorney-General, care of Crown Law Office, P.O. Box 5012, Wellington, not less than 7 clear days before the above-mentioned date.
