Notification of Exemptions From Land Transport Rules

Pursuant to section 166 (3) of the Land Transport Act 1998, I, William John McCook, General Manager, Operations, Land Transport Safety Authority, notify the following exemptions from Land Transport Rules were made under section 166 (1) of that Act, during the period 1 January 2001 to 31 March 2001:

Exemption from Parking Brake Requirements (Hydraulic Handbrake Alternative)

Pursuant to Regulation 36 of the Transport (Vehicle Standards) Regulations 1990, and to Regulation 90 (1) of the Traffic Regulations 1976, I, Simon Christopher Whiteley, Manager Safer Vehicles Policy, exempt the specified class of motor vehicles from Regulation 13 (1) (c) of the Transport (Vehicle Standards) Regulations 1990, and from the requirement in Regulation 68 (1) of the Traffic Regulations 1976 that every motor vehicle shall have a parking brake, subject to the conditions specified in the Schedule below.

This exemption may be withdrawn at any time.

Specified Class

The specified class of motor vehicle is:

Any vehicle that is registered with and complies with the Motorsport New Zealand Inc requirements, and with Schedule A of the New Zealand Motorsport Manual.

Schedule of Conditions

1. Motorsport New Zealand Inc issues a “Motorsport Authority Card” with both Land Transport Safety Authority and Motorsport New Zealand Inc original logos to the owner of the vehicle.

2. The “Motorsport Authority Card” must be carried in the vehicle at all times and produced when requested by Police, Land Transport Safety Authority or Warrant of Fitness Authorities.

3. The “Motorsport Authority Card” shall identify the vehicle and vehicle owner, and be of an acceptable format to the Land Transport Safety Authority. The “Motorsport Authority Card” is not transferable.

4. In the event of the vehicle ceasing to comply with these conditions, the appropriate mechanical parking brake for road use must be fitted to the vehicle.

5. The vehicle must be fitted with a hand operated hydraulic brake that will, on application, bring the vehicle to a standstill within a distance of 18 metres from a speed of 30 kilometres an hour or will hold the vehicle at rest on a grade of 1 in 5.

6. The handbrake must perform the function of a parking brake. However, being hydraulically operated, the handbrake may not apply sufficient braking force for an indefinite period without further attention, and therefore the following warning notice must be placed in such a position that it may be easily read by the driver:

   “Warning this vehicle is fitted with a hydraulically operated parking brake that cannot be relied on to hold the vehicle for an indefinite period. The vehicle’s wheels must be chocked if left unattended.”

7. If the fitting of a hydraulic handbrake involves modification of the vehicle’s service braking system, the vehicle must be certified as complying with the requirements of the Low Volume Vehicle Code.

The exemption “Exemption from Parking Brake Requirements (Hydraulic Handbrake Alternative)” published in the New Zealand Gazette, 28 July 1994, No. 75, page 2420, is hereby revoked.
