Conditions

(i) Bolster attachments to use existing design with 250,000 kilometres recorded truck operation without failure.

(ii) Minor modifications to the existing design are only permissible if the certifier can demonstrate by calculation or approved type test that the performance and life of the bolster attachments have not been diminished by the modifications.

(iii) This exemption will expire on recertification of the bolster attachments to a type testing process approved by the Log Transport Safety Committee and the Land Transport Safety Authority, or on certification to a version of the code of practice for log bolster attachment which incorporates revised requirements for the attachment of convertible bolsters.

Public Works Act 1981

Notice of Intention to Take an Interest in Land—Harrington Point Road, Portobello District

Notice is hereby given that, in accordance with section 23 of the Public Works Act 1981, the University of Otago (“the university”) proposes to take an interest in the land described in the Schedule hereto (“the land”).

The interest required in the land is an easement (“the easement”) to enable use of the land for access and for the location of services, all for the university’s purposes, namely the purposes of its Portobello Marine Laboratory.

The easement required is more particularly described in the Schedule hereto.

The intended taking is considered reasonably necessary for the efficient provision of access and services to the university’s Portobello Marine Laboratory. The land over which the easement is sought is that land currently in use for the purpose of vehicular access.

The owners of the land and those persons with a registered interest in it have been served with notice of the university’s intention to take the land and advised of their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, P.O. Box 5027, Wellington, within 25 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held. The objector will have a right to appear and be heard personally unless the objector otherwise requires. Each objector will be informed of the time and place of the hearing.

Portobello District
The land is the land on Portobello Peninsula and is described as Sections 16-22, Block VI, Portobello District, being all the land in certificate of title 2C/1395.

The easements required are easements of right of way, rights to convey water, wastewater, sewage, electricity and telephone and other electrical impulses in gross over, under and through those areas “C”, “D” and “E” on S.O. Plan 22930, lodged in the office of the Chief Surveyor, Land Information New Zealand, Dunedin.
