Māori Land Development Notice

Pursuant to section 21 of the Māori Affairs Restructuring Act 1989, the Chief Executive of the Ministry of Māori Development hereby gives notice as follows.

Notice

  1. This notice may be cited as Māori Land Development Notice, Hamilton 2001, No. 3.

  2. The notice referred to in the First Schedule hereto is, in relation only to the piece of land described in the Second Schedule hereto, hereby revoked.

  3. The land described in the Second Schedule hereto is hereby released from Part II of the Māori Affairs Restructuring Act 1989.

Background

On 21 November 1997, the Crown and Te Rūnanga O Ngāi Tahu entered into a Deed of Settlement, setting out the terms of the settlement reached to give effect to the claims made by Te Rūnanga O Ngāi Tahu. The major part of the settlement was related to the main claim on behalf of the Ngāi Tahu iwi. However, minor claims that related to individual hapū or whānau were set aside and responsibility given to a special Trust set up for the purpose to vest these minor claims in the descendants of the original owners of the land or fisheries reserves alienated in some cases over 100 years ago.

Ancillary Claim Properties

There are 32 individual claim properties, 9 of which are all based on customary fishing areas. The total assessed value of the 32 properties is a little over $1,000,000.00, but the cultural value is of lasting significance to Ngāi Tahu descendants.

Research

The Ancillary Claims Trust was established in November 1998 and, since then, the priority has been to carry out the necessary research to establish the original owners. This research has now been completed and this notice is the final of three notices to locate the descendants of the original owners in three groups of areas.

Properties to be Vested

The claim properties in this final batch are situated in Kaikoura and in South Westland.

The properties below are in Kaikoura.

Kaikoura Town Section
Means the land described as Marlborough Land District, Kaikoura District Council, 9930 square metres, more or less, being Section 1, S.O. 6917. All C.T. 4D/1316, as shown on Allocation Plan A 104 (S.O. 7320).

Kaikoura Suburban Site
Means the land described as Marlborough Land District, Kaikoura District Council, 3.9090 hectares, more or less, being Section 1, S.O. 6949. All C.T. 4D/1424, as shown on Allocation Plan A 105 (S.O. 7321).

The properties below are in South Westland at Awarua, Okahu, Paringa and Whakapohai.

Awarua Site
Means the land described as Westland Land District, Westland District Council, 40.4686 hectares, more or less, being Rural Section 881 (S.O. 5650). All C.T. 8B/514.
Subject to a deed of grant of easement of right of way embodied in Register Book 8B/839, as shown on Allocation Plan AS 509 (S.O. 12518).

Okahu Replacement Site
Means the land described as Westland Land District, Westland District Council, comprising:
(a) 4.2492 hectares, more or less, being part Reserve 1692;
(b) 4.2492 hectares, more or less, being part Reserve 1692;
(c) 4.2492 hectares, more or less, being part Reserve 1692;
(d) 4.2492 hectares, more or less, being part Reserve 1692.
Subject to survey as shown on Allocation Plan AS 205 (S.O. 12494).

Okahu Site (No. 4)
Means the land described as Westland Land District, Westland District Council, 4.0581 hectares, more or less, being Rural Section 5523 (S.O. 9683). All New Zealand Gazette 1993, page 1031, as shown on Allocation Plan AS 210 (S.O. 12496).

Paringa River Site
Means the land described as Westland Land District, Westland District Council, 20.2342 hectares, approximately, being Part Rural Section 660. Subject to survey as shown on Allocation Plan AS 203 (S.O. 12492).

Whakapohai Site
Means the land described as Westland Land District, Westland District Council, 0.7200 hectares, approximately, being Part Rural Section 6161, adjoining Sections 1 and 2, S.O. 11845. Subject to survey as shown on Allocation Plan AS 493 (S.O. 12502).

The properties below are compensation for land that was not allocated but should have been allocated in South Westland.

Arawhata Site No. 1
Means the land described as Westland Land District, Westland District Council, 12.5 hectares, more or less, being Section 1, S.O. Plan 11836. Part certificate of title 8A/496.
Subject to a right to convey water in gross created by transfer 091679. Subject to survey as shown on Allocation Plan A 206 (S.O. 12495).
