"label" means the compliance mark in conjunction with the supplier identification engraved on, or otherwise affixed to, a product;
"Ministry" means the Ministry of Economic Development;
"product" means interfacing equipment or susceptible equipment as defined in the Radiocommunications Act 1989, and includes any assembly of components, modules or sub-assemblies that form a finished product;
"product description" means text, drawings, photographs, sketches, diagrams or any other thing identifying the manufacturer, make, model, function, or internal and external construction of a product;
"RCM" means the following symbol:
"regulation" and "regulations" means regulations made pursuant to the Radiocommunications Act 1989;
"standard" means a publication, or those parts of a publication, prescribing the measurement procedures, processes, and limits relating to the electromagnetic compatibility of products;
"supplier" means:
(i) for the requirements of levels of conformity 1, 2 and 3, a person in New Zealand supplying products in New Zealand;
(ii) for the requirements of level of conformity A, a person supplying products in New Zealand;
"supplier code number" means the letter “Z” and a unique numeric identifier allocated by the Chief Executive;
"supplier identification" means any of the following:
(i) the supplier code number;
(ii) the supplier’s registered name and address;
(iii) the supplier’s registered company number;
(iv) the supplier’s registered GST number;
(v) the supplier’s registered trademark;
"technical construction file" means:
(i) a technical report prepared by a competent body confirming that a product meets the requirements of the applicable standard; and
(ii) a statement of reasons if the information is incomplete;
"test report" means:
(i) the text, drawings, diagrams and tables specifying the standard or standards to which a product has been tested; and
(ii) the general procedure followed in testing the product; and
(iii) the measurement results; and
(iv) a statement as to whether or not the product conforms to the standard or standards to which the product has been tested:
(b) Other words and expressions contained in this notice that are defined in the Radiocommunications Act 1989 have the meanings so defined.
3. Scope
(a) Subject to subsections (b), (c), and (d), unless expressly stated to the contrary in this notice:
(i) A product used, sold, or otherwise distributed in New Zealand, or manufactured for supply in New Zealand, must conform to an applicable standard;
(ii) a person supplying a product in New Zealand must comply with the requirements of this notice.
(b) For the purposes of regulation 32(1)(a), (b), (c), and (d), the classes of products, and the applicable standards and levels of conformity applying to those classes of products, are those specified in Schedule A and Schedule B of this notice.
(c) For the purposes of regulation 32(1)(j), if a device fits any of the following descriptions, the requirements of this notice do not apply. The devices are:
(i) those with a power consumption not exceeding 6 nanowatts;
(ii) military equipment or weapons systems of the New Zealand Defence Force;
(iii) military equipment or weapons systems of the defence force of another country operating in co-operation with the New Zealand Defence Force.
(d) A product to which this notice applies is deemed to comply with the requirements of this notice if the product meets the requirements of an agreement between New Zealand and another country or a body, as specified in Schedule C of this notice.
