RADIOCOMMUNICATIONS

(ELECTROMAGNETIC COMPATIBILITY COMPLIANCE)

NOTICE 2001

Pursuant to regulation 19(2) and regulation 32(1) of the Radiocommunications Regulations 2001, the Manager, Radio Spectrum Management, Ministry of Economic Development, acting under delegated authority from the Chief Executive, Ministry of Economic Development, hereby gives the following notice:

NOTICE

1. Title and commencement

(a) This notice is the Radiocommunications (Electromagnetic Compatibility Compliance) Notice 2001.

(b) This notice comes into force on 12 October 2001.

2. Interpretation

(a) In this notice, unless the context otherwise requires, -

"accredited testing body" means a facility that is any of the following:

(i) accredited by International Accreditation New Zealand, an agency of the Government also known as IANZ;

(ii) accredited by an accreditation authority that has entered into a mutual recognition arrangement with IANZ;

(iii) approved pursuant to any agreement between New Zealand and any other country or countries;

"Act" means the Radiocommunications Act 1989;

"applicable standard", in relation to a product, means a standard or code of practice prescribed in this notice applying to the class of product to which the product belongs, and any published amendment or modification to the standard in force from time to time;

"battery powered", in relation to a product, means a product that is not capable of being connected, either directly or indirectly, to the electrical mains supply;

"Chief Executive" means any of the following:

(i) the Chief Executive of the Ministry of Economic Development;

(ii) a person acting under delegated authority from the Chief Executive;

"class of product" means a grouping, category, or family of products with a common purpose, use or application;

"code of practice" means a publication prescribing the procedures and processes relating to any of the following:

(i) the installation and maintenance of products;

(ii) the interconnection of products;

(iii) the networking of products;

(iv) the assembling of components, modules and sub-assemblies to form a finished product;

"competent body" means a body determined to be a competent body in any of the following:

(i) a notice made under regulation 32(1)(h) of the regulations;

(ii) an instrument made under subsection 183(3) of the Australian Radiocommunications Act 1992;

"compliance folder" means, in relation to a product, a dossier comprising a declaration of conformity, a product description and test report or technical construction file;

"compliance mark" means the C-tick or the RCM;

"C-tick" means the following symbol:

"declaration of conformity" means the documents prescribed in Schedule E or Schedule F of this notice;

"fixed installation" means a combination of parts, components, modules, or products assembled and installed at a place of use in such a way that the combination cannot be moved without being at least partially disassembled, including electric power lines and wired telecommunication distribution networks, but not including telecommunications terminal equipment designed for installation in customer premises;
