  • (i) reflect the ethnic and socio-economic diversity
    of the communities served by the Auckland
    University of Technology;

  • (ii) reflect gender balance;

  • (iii) provide for governance experience, capabilities
    in financial and strategic planning, and/or
    educational and community knowledge, in the
    work of the council; or

  • (iv) provide for adequate continuity of council
    membership during the transition to this new
    Constitution on 1 January 2002.

(o) After 1 January 2004, up to four members to be
co-opted by the Auckland University of Technology
Council, as it determines, to better:

  • (i) reflect the ethnic and socio-economic diversity
    of the communities served by the Auckland
    University of Technology;

  • (ii) reflect gender balance; or

  • (iii) provide for governance experience, capabilities
    in financial and strategic planning, and/or
    educational and community knowledge, in the
    work of the council.

  1. A person who is a permanent member of staff of the
    Auckland University of Technology, or who is a student of
    the Auckland University of Technology shall not be eligible
    for election, appointment or co-option as a member of
    council, unless they are elected or appointed pursuant to
    paragraphs 1 (a), (b), (c), (d), (e), (f) and (g).

  2. A person is not eligible for appointment, election or
    co-option as a member of the Auckland University of
    Technology Council, if:

  • (a) except in the case of a student member, the person
    has not attained the age of 18 years; or

  • (b) the person is a mentally disordered person within the
    meaning of the Mental Health (Compulsory
    Assessment and Treatment) Act 1992; or

  • (c) the person is a bankrupt who has not obtained his or
    her order of discharge or whose order of discharge
    has been suspended for a term not yet expired or is
    subject to conditions not yet fulfilled.

  1. The term of office of members of the council, vacation
    of office, disclosure of members’ interest and casual
    vacancies are covered in sections 173-176 of the Education
    Act 1989.

  2. Subject to section 173 of the Education Act 1989, no
    member other than the Chief Executive Officer shall have
    more than two consecutive terms or any one term of more
    than four years.

  3. No act or proceeding of the Auckland University of
    Technology Council, or of any committee of the council,
    shall be invalidated as a result of:

  • (a) a defect in the appointment, election or co-option of
    a member of the council, or of any committee of the
    council; or

  • (b) a disqualification of a member of council or of any
    committee of the council; or

  • (c) a defect in the convening of a meeting; or

  • (d) a vacancy or vacancies in the membership of the
    council, or of any committee of the council.

Student Election Extension Notice

Pursuant to clause 9 (2) of the Sixth Schedule to the
Education Act 1989, and acting with authority delegated
by the Minister of Education, I hereby extend the closing
date for receiving nominations and all subsequent actions
in accordance with the Education (School Trustee
Elections) Regulations 2000, for the election of the student
representative for the Kaikohe Christian School Board of
Trustees.

The closing date for voting will be 30 October 2001.

This notice takes effect the day after its notification in the
New Zealand Gazette.

Regulations 1998

Cancellation of Licence for an Early Childhood Centre

Pursuant to Regulation 12 (1) of the Education (Early
Childhood Centres) Regulations 1998, and acting under
authority delegated by the Secretary for Education, I hereby
cancel the licence dated 4 October 1999, which was granted
under those regulations to Sharon Walch in respect of
Te Awanga Kindergarten (55046), situated at Wellwood
Terrace, Te Awanga, Hastings.

This notice shall take effect the day after the date of its
notification in the New Zealand Gazette.

Cancellation of Licence for an Early Childhood Centre

Pursuant to Regulation 12 (1) of the Education (Early
Childhood Centres) Regulations 1998, and acting under
authority delegated by the Secretary for Education, I hereby
cancel the licence dated 28 May 2001, which was granted
under those regulations to Robyn Koupa in respect of
Arakura Playcentre (60012), situated at Arakura School,
Wellington Road, Wainuiomata.

This notice shall take effect the day after the date of its
notification in the New Zealand Gazette.
