Land Acquired for Road—State Highway No. 6, Wharf Creek Bridge, Queenstown Lakes District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the Schedule to this notice is acquired for road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 6 and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

Road Realignment—Hauroto Bay Road, Waikato District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares:

(a) Pursuant to section 114 (1), the lands described in the First Schedule to this notice to be road and shall vest in the Waikato District Council on the date of publication of this notice in the New Zealand Gazette.

(b) Pursuant to sections 116 (1), 117 (3) and 120 (3), the portions of road described in the Second Schedule to be stopped and amalgamated with the land in certificate of title 32B/659, subject to the encumbrances thereon.

(c) Pursuant to section 116 (1), the portions of road described in the Third Schedule to be stopped.

Acquisition of Easements—Freyberg Park Stormwater Detention Dam, North Shore City

Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, easements in gross are acquired and vested in the North Shore City Council to direct or divert water into and to concentrate water on the lands described in the First Schedule hereto, in accordance with the rights and powers set out in the Seventh Schedule to the Land Transfer Act 1952 and in the Second Schedule hereto.

Easement Conditions:

The owners of the land described in the First Schedule shall not:

1. place or erect or allow to be placed or erected any solid buildings or structures on the land and will not alter the contours thereof and will not at any time hereafter do, permit or suffer to be done any act whereby the rights, powers and licences and liberties hereby granted to the North Shore City Council may be interfered with or prejudiced in any way without the express written consent of the North Shore City Council.

2. allow the habitable floor level of any building on or above the land to be placed or constructed below 5.71 metres reduced level in terms of Land Information New Zealand datum.
