Public Works Act 1981

Notice Pursuant to Clause 23 (1) of the Public Works Act 1981

Watercare Services Limited (“Watercare”) proposes to acquire the land described in the Schedule, pursuant to the Public Works Act 1981.

The land is required for wastewater treatment purposes, maintenance of an odour buffer, and application of biosolids in connection with the upgrading and ongoing operations of the wastewater treatment plant (“WTP”) at Mangere.

The reasons Watercare considers it essential to take your interest in the land area include the need:

(a) to ensure sufficient land is available for the discharge of sludge/biosolids on to or into land in connection with the trials and investigations in the beneficial reuse of such material;

(b) to enable an odour buffer of sufficient size such that any odours from the WTP are adequately dissipated at the odour buffer boundary;

(c) to ensure control over the development and use of all areas within the designated odour buffer, being an area potentially affected by odour following completion of upgrading works;

(d) to avoid or minimise any potential conflict between the WTP and associated activities (such as the application of sludge/biosolids) and other activities in the immediate vicinity of the WTP; and

(e) to enable the effective and efficient operation of the WTP for the foreseeable future.

Anyone claiming an interest in the land (other than the registered proprietor of the freehold estate) may object to the acquisition of the land by Watercare. A written objection should be sent to the Registrar, Environment Court, Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington, prior to Friday, 21 September 2001.

(i) Part of the property at 110-116 Greenwood Road, Mangere, comprising 5.4946 hectares, more or less, being Lots 1 and 2, Deposited Plan 45046 and part Lot 1, Deposited Plan 56180 and being part Allotment 83, Parish of Manurewa and comprised in certificate of title 20C/286 (North Auckland Registry).

(ii) Part of the property at 76 Greenwood Road, Mangere, comprising 8.9675 hectares, more or less, and being part Allotment 83, Parish of Manurewa and comprised in certificate of title 30A/1424 (North Auckland Registry).

(iii) All of the property at 70 Greenwood Road, Mangere, comprising 1.8299 hectares, more or less, being part Lot 9, Deposited Plan 16117 and being part Allotment 23, Suburbs of Mangere and comprised in certificate of title 3D/1195 (North Auckland Registry).

(iv) All of the property at 62 Greenwood Road, Mangere, comprising 2.0064 hectares, more or less, being Lot 10, Deposited Plan 16117 and being part of section 23, Suburbs of Mangere and comprised in certificate of title 380/209 (North Auckland Registry).

Land Declared Road—Heaton Road, Whangarei District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the Schedule to this notice is hereby acquired for road and vested in the Whangarei District Council on the date of publication of this notice in the New Zealand Gazette.

Amending a Notice Vesting of Stopped Road—Coronation Road, Mangere Bridge, Manukau City

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand, hereby amends the notice dated 21 April 1995, Vesting of Stopped Road, described in the Schedule to this notice, published in the New Zealand Gazette, 27 April 1995, No. 39, page 1055, by the addition of the words

"as to an undivided four-tenths share, certificate of title No. 48B/47 as to undivided three-tenths share and certificate of title No. 48B/48 as to undivided three-tenths share"

after the words

"amalgamated with certificate of title No. 48B/46"

on the sixth line of the aforesaid Gazette notice.
