Land Acquired for a Refuse Site—Stewart Island

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the Schedule to this notice is hereby acquired for a refuse site and is vested in the Southland District Council on the date of publication of this notice in the New Zealand Gazette.

Amending a Notice Realigning Road at Nokomai in the Southland District

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, hereby amends the notice dated 24 May 2000, realigning road, published in the New Zealand Gazette of 1 May 2000, No. 59, at page 1299, by:

(a) deleting paragraph (c) (iii) and substituting it with the following:
“Pursuant to section 52 of the Public Works Act 1981, the land twenty-fifth to twenty-seventh described (both inclusive) shall be set apart as Crown land and vested in the Minister of Lands as part of the bed of the Nokomai River.”

(b) adding to the Third Schedule the land twenty-seventh described as:
“0.7950 Part Crown land reserved from sale (marginal strip), situated in Blocks I and IV, Nokomai Survey District; marked “Tt” on S.O. Plan 12274.”

Land Acquired for Conservation Purposes (Marginal Strip) and Land Acquired for Road—State Highway No. 25 Tairua Road, Thames-Coromandel District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that:

(a) Pursuant to section 20 (1), declares that pursuant to an agreement to that effect having been entered into, the land described in the First Schedule to this notice is acquired and vested into Crown land reserved from sale (marginal strip), pursuant to section 58 of the Land Act 1948.

(b) Pursuant to section 20 (1), declares that, pursuant to an agreement to that effect having been entered into, the land described in the Second Schedule to this notice is acquired for road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 25 and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

Land Acquired for Development of Public Amenity in Ashburton District

Pursuant to sections 20 and 50 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule to this notice is acquired for development of public amenity and vested in Ashburton District Council on the date of publication of this notice in the New Zealand Gazette, subject to the reservation in favour of the Crown for railway purposes of the easement set out in the Second Schedule.

6093 square metres, being part Reserve 1650; shown as “B” on S.O. Plan 19678, lodged in the office of the Chief Surveyor at Christchurch.

Second Schedule

Right of way easement over the land in the First Schedule (the servient land) forever as an easement in gross for railway purposes on the terms and conditions set out in the Seventh Schedule of the Land Transfer Act 1952, subject to the following:

The formation, maintenance and repair of the right of way shall be at the sole cost of the party having the benefit of the easement.
