Conditions

  1. The vehicle operation must comply with the safety plan, dated 20 January 2000, that has been lodged with the LTSA’s Auckland office.

  2. A maintenance log must be kept and signed by the person completing the repairs or routine maintenance. This log must be presented on demand to any police constable or officer of the LTSA.

  3. The vehicle operation is confined to the America’s Cup Village roads as defined in the safety plan.

  4. The maximum speed at any time must not exceed 5kph.

  5. The vehicle operator must wear a crash helmet.

  6. No passengers are to be carried on the vehicle.

  7. The vehicles must be maintained up to warrant of fitness standard at all times.

  8. The vehicle is to be fitted with an orange flashing light which is to be operated at all times when the vehicle is within the Cup Village.

  9. Any trailer that is towed by this vehicle must be maintained up to warrant of fitness.

  10. The vehicle is to be fitted with a bleeper that is to be operated when the vehicle is used on pedestrian malls or walkways.

  11. This exemption may be revoked at any time.

  12. A copy of this notice must be readily available for inspection.

  13. This exemption notice will expire on 30 April 2000.

Declaration Under the Submarine Cables and Pipelines Protection Act 1996

Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Maritime Safety Authority by an Instrument of Delegation dated 19 March 1997.

And whereas, pursuant to section 442 of the Maritime Transport Act 1994, the Maritime Safety Authority did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Director of Maritime Safety by an Instrument of Delegation dated 26 March 1997.

Therefore I, Russell Paul Kilvington, Director of Maritime Safety, hereby make the following declaration:

Declaration

The Order in Council, under section 12 of the Submarine Cables and Pipelines Protection Act 1996, entitled the Submarine Cables and Pipelines Protection Order 1992, shall not apply in respect of the following class of ships:

Patrol boats acting for or on behalf of the Takapuna Boating Club Inc

in the protected area designated “Area 2—Hauraki Gulf” for the purpose of race management with conditional approval from Telecom New Zealand, for an indefinite period of time.

This notice comes into effect on and from the 27th day of January 2000.
